Mehserle Faces up to 14 Years in Prison

OAKLAND, Calif. (KCBS/BCN)- It'll be nearly one month before Johannes Mehserle learns his fate as his sentencing in the case is scheduled for August 6th.

The former BART police officer was convicted of involuntary manslaughter with a "gun enhancement", meaning the jury found he'd used a gun to carry out the crime.

He could be sentenced to 5 to 14 years in prison.

In the meantime it's possible there could be more criminal proceedings against Mehserle.

There's word the U.S. Department of Justice plans to conduct an independent review of the case to determine whether the shooting merits federal prosecution.

"The Justice Department has been closely monitoring the state's investigation and prosecution," the department said in a statement.

A $50 million wrongful death and civil rights suit has been filed on behalf of Grant's family against BART and Mehserle.

Congresswoman Barbara Lee (D-Oakland) said she has been in touch with the justice department.

"I remain in close contact with the Department of Justice and will continue to work with them, the family and the community in the days ahead," she said in a statement.

BART's lawyers and an attorney for the Grants say they will seek mediation.
