Teen To Be Retried In '05 Redwood City Gang-Related Killing

REDWOOD CITY (AP) - A teenager will be retried next year for the gang-related shooting death of a Redwood City man five years ago.

San Mateo County prosecutor Steve Wagstaffe said a judge ruled Wednesday that 19-year-old Josue Orozco, who was 14 at the time of the July 2005 shooting, will face a second trial starting March 14.  A deadlocked jury in December led to a mistrial.

Prosecutors say Orozco killed 21-year-old Francisco Rodriguez with a gunshot to the head in the driveway of a Redwood City apartment complex. Investigators say it was a dispute between rival gangs.

The San Jose Mercury News reported Orozco is also facing charges of witness intimidation for allegedly orchestrating from his jail cell a conspiracy to prevent witnesses from testifying against him.
