Marin County Sues To Block New San Quentin Death Row

SAN  QUENTIN (AP) - Marin County has filed a lawsuit seeking to block the state from beginning construction on a $356 million death row complex until all legal issues are resolved.

Still, the Department of Corrections and Rehabilitation opened bids this week for the first phase of the project, and officials have vowed to move forward on the 1,152-bed facility at San Quentin State Prison.

The lawsuit filed Tuesday seeks a temporary restraining order on construction while a court decides a pending suit by the county that accuses Gov. Arnold Schwarzenegger of improperly vetoing budget control language for the financing of the project.

The vetoed language would have prohibited bonds from being issued until legal concerns over prison overcrowding and an environmental analysis were resolved.
