San Jose Homeowner Shoots Suspected Burglar

SAN JOSE (CBS/BCN) — A homeowner shot a man suspected of burglarizing his home in San Jose early Friday morning, a police spokesman said.

The shooting was reported at 4:18 a.m. at a home in the 1700 block of Patio Drive, San Jose police Officer Jose Garcia said.

Officers responded and found a man suffering from a gunshot wound to the torso in the backyard of the resident’s home, Garcia said.

The man was taken to a local hospital with injuries that are potentially life-threatening, he said.

“It appears the homeowner shot the suspected burglar, although we’ve yet to obtain a statement from the gunshot uncooperative victim to determine exactly what occurred,” Garcia said.

He said the man who owns the home was being interviewed about the shooting by investigators this morning and has not been arrested.

    That is the exact same fate anyone in my back yard would face at 4am. Sadly this piece of dirt’s family will likely sue the guy. Still, I’d rather be in court than dead in my own house.

    the issue here however is that the burglar is in the backyard, which is at best trespassing; we have a right to shoot someone in our home, but not on our property ie if you shoot them outside, drag ‘em in. (this is actually contrary to a case in TX last year, however). The investigators are surely asking if the burglar was in the home, shot, then made his way outside – or was shot outside when shot, presumably posing little to no threat to the homeowner

    You shouldn’t be in someone else’s yard or on someone else’s property at 4am uninvited or unknown to the homeowner PERIOD. Go Homeowner. Uncooperative “gunshot victim” aka thug up to no good.

    If I was awoken by a noise at 4am and came face to face with an intruder, I would be so overwhelmed with fear that I would probably immediately point and shoot and shoot and shoot and shoot

    In today’s proliferation of automatic weapons, what homeowner can afford to stand around with his finger in his ear trying to figure out if the intruder has a gun or not?
    The intruder doesn’t belong where he is and should be deemed to be taking his chances.
    However, let us hope he survives.

    Unbelievable, if someone knocks on my door at 4 AM I’m answering the door my gun in hand, if someone’s in my back yard, he already crossed the line and I aint taking any chance that he is not armed, his butt is getting capped. Now days, if you stop to wonder, it might be to late.
