No Criminal Charges In Oakland School Sex Case

OAKLAND (CBS / AP) ― Oakland police closed their investigation into the case of two second-graders who engaged in sexual conduct in a school classroom last month, saying no criminal charges would be filed.

Police spokeswoman Holly Joshi said Thursday that investigators didn't believe an adult orchestrated or participated in the acts that some students said included other students stripping off their clothes during class and engaging in oral sex.

KCBS' Chris Filippi Reports:

A second-grade teacher at Markham Elementary School has been on paid administrative leave since the incidents were reported on Jan. 20. The teacher had denied knowing about any such behavior.

Joshi said that students interviewed gave similar and what she described as "pretty accurate accounts of what occurred" in the classroom on the day in question.
