Driver Hits, Kills Friend Leaving House Party On His Bike

SAN JOSE (CBS SF) — A bicyclist was struck and killed by a car in San Jose early Saturday morning, according to police.

The victim, a 32-year-old San Jose resident, was on his bicycle in the middle of Cherry Avenue near Foxworthy Avenue when he was struck by a 2004 Subaru at about 2 a.m., police said.

Responding paramedics couldn’t revive the bicyclist and pronounced him dead at the scene, according to police.

The driver, also a 32-year-old San Jose resident, was apparently friends with the bicyclist, and both had been at a house party nearby before the crash, police said.

Police questioned the driver at a local station, and he was later released without charges. Investigators have not yet said if alcohol or drugs were a factor in the collision.

      Sometimes an accident is just that, an accident.

    It was 2 in the morning and pitch dark. This was clearly an unfortunate accident of being in the wrong place at the wrong time. If the police suspected the car driver committed a crime, they would have arrested him. I’m sure they gave him tests for DUI and he must have passed. Obviously we know few facts to make a judgement but it is possible that the bike driver was impaired. How often do you scan the surrounding areas foe bike drivers late at night ?
    In any event, the police could arrest the driver later, or most likely there will be CIVIL litigation in the future. When it’s your time…it’s your time.

    By-the-way – just because it is dark is no excuse for not being vigilant – in fact one needs to be MORE so……


    Sorry but this mentality that to ride bicycles in any and all conditions is justifiable needs to be reevaluated ! Bicyclists are hard to see especially at night . And riding in and around vehicular traffic is inherently DANGEROUS ! I don’t know who was right or wrong in this case and my condolences to the poor unfortunates family .

      Yes, but perhaps people should think twice before driving their cars to parties at which there will be lots of alcohol consumption. The bicycle is what killed this man; it was a car.

    Please keep all irrelevant and brainless comments to yourselves. This was TRULY a tragic accident. Both sides of families/friends have lost a great person, husband, father and friend. The driver was very close to him and is struggling greatly right now. Please keep him in yours prayers for strength, for he needs it most .

    Riding a bike in the dark w/o a light can be hazardous to your health. Mix in a little alcohol and its deadly.
