Judge Upholds Release Of Mehserle From Prison Monday

LOS ANGELES (CBS 5) -- A former Bay Area Rapid Transit police officer convicted in Los Angeles of fatally shooting an unarmed man at Oakland's Fruitvale BART station will be released from custody on Monday, a judge reaffirmed Friday.

Johannes Mehserle was sentenced in November to two years in prison.

The 29-year-old Mehserle has been in custody since his conviction July 8, 2010 for involuntary manslaughter in the death of Oscar Grant.

Los Angeles Superior Court Judge Robert J. Perry reaffirmed in an order issued Friday that with time-served and good-conduct credits, Mehserle must be released Monday.
