CBS 5 Poll: Most Californians Disagree With Casey Anthony Verdict

SAN FRANCISCO (CBS 5 / CBS News) — An overwhelming majority of Californians were surprised by and disagreed with a Florida jury’s not guilty verdict Tuesday in the Casey Anthony murder trial, a KPIX-TV CBS 5 poll has found.

Jurors in Orlando found Anthony not guilty of first-degree murder, aggravated child abuse and aggravated manslaughter in the 2008 death of her 2-year-old daughter Caylee. She was found guilty of four lesser charges of providing false information to a law enforcement officer.

The poll, conducted for CBS 5 by the firm SurveyUSA, found 77% of Californians disagreed with that veridct, 72% indicated that they were surprised by the jury’s decision and 75% believed that Anthony did kill her daughter.

The CBS 5 poll surveyed 409 California adults who indicated that they had followed the trial. The poll was conducted Tuesday following the jury’s verdict and has a margin of error of plus or minus 4.4%.

Anthony will be sentenced Thursday for the four lesser charges she was convicted of. While she could receive up to a year in jail for each count, legal expert Mark O’Mara told CBS that he expected Anthony to get credit for time served. She has been in jail since October 2008.

Anthony, 25, has been on trial since May 24 in a case that has been broadcast across the country, starting with Caylee’s disappearance in 2008. Caylee’s decomposed body was found in the woods near the Anthony’s home and a medical examiner was never able to determine how she died.

Caylee was reported missing on July 15, 2008, after Anthony told her parents she had not seen Caylee since she was kidnapped by a nanny on June 16, 2008.

Later at trial, the defense said she lied about the nanny, claiming that Caylee had actually died in the family swimming pool on June 16. They stated that her seemingly carefree attitude was in fact a way for her to hide the emotional distress caused by sexual abuse from her father.

Anthony did not take the stand during the trail, leaving her claim as to how Caylee died unsubstantiated.

The prosecution contended that Caylee was suffocated with duct tape by her mother, who loved to party, tattooed herself with the Italian words for “beautiful life” in the month her daughter was missing and crafted elaborate lies to mislead everyone from investigators to her own parents.

Many dedicated followers of the trial camped outside the courthouse daily to get a spot to watch the drama from inside the courthouse. It was this public fascination and heavy media attention that caused jury selection to take place outside of Orlando. Jurors were brought in from the Tampa Bay area and sequestered for the entire trial.

Anthony cried after the verdict was read and hugged her attorney Jose Baez.

“While we’re happy for Casey, there are no winners in this case,” Baez said at a news conference after the verdict was delivered. “Caylee has passed on far, far too soon and what my driving force has been for the last three years has been always to make sure that there has been justice for Caylee and Casey because Casey did not murder Caylee. It’s that simple. And today our system of justice has not dishonored her memory by a false conviction.”

      Clearly people had their opinion before they heard the facts. She wasn’t smart enough to pull this off on her own and it took someone with experience. Not enough proof to confict. I figured a hung jury. Go after the GRANDFATHER!

    You think most Californians would lock up anyone based on such little if nonexistent
    evidence. Of course they would. This case goes to show how bad it is here most would say guilty before innocence and i am totally ashamed of most americans that can not accept justice.
    Shame on you if you do not like the verdict in the case leave the U.S. and get out…

    What a stupid thing to be doing. Taking a poll of people this far away. People that probably didn’t see anything about the trial other that FH Nancy Grace or the pimps at TMZ.

    Both the prosecution and the defense present their case, it is up to the jury to decide. Lots of murder cases have been decided without direct evidence resulting in a guilty verdict. This verdict handed down today is based on what we used to call the “Perry Mason Syndrome”, to much TV time and little common sense by the jury. They tell you what you can consider and what not to consider, they bring in experts who are paid to say anything depending what side you represent, they cloud the main issue and sometime tell LIES. WHO DID IT, WHO KILLLED CAYLEE ANTHONY. If when you go to bed and it is dry outside but when you wake up and everything is wet, but it is not raining what does common sense and good judgement tell you. We are at a time in our history where common sense and old fashion good judgement has left us. You can twist and distort the truth but the truth is always the truth, you just have to be smart enough to see it. Cay lee Anthony will never see justice, too bad.

      I’m absolutely stunned how many people without any evidence of any kind have no problem “convicting” George Anthony of being involved, or “hiding something” (as the alternate juror who spoke out put it)–but argue that there is no evidence against Casey Anthony. The mind reels.

      Not only WHO put the duct tape over the child’s mouth, but WHY? Seriously. can anyone think of ANY GOOD reason for taping someone’s mouth??

      Just because the trial is ended, does not mean these questions have been answered…they have NOT.

        The argument some people have put forward is that duct tape was placed over her mouth and nose to prevent bodily fluids from leaking out after death. This makes no sense, since the really significant bodily fluids that leak out after death are urine and feces, and no effort was made to prevent THOSE from leaking out. And by the way, the plastic garbage bag they put her in would already prevent bodily fluids from leaking anywhere. But that is the only theory I’ve heard. It’s too bad the jury wasn’t able to believe it, but the question of who and why has been fully answered.

    This is another example of someone being tried in the press and the press being wrong because it is comprise of a collection of bigots. Rather than admitting they are wrong and theat they engaged in character assination without knowing what they are taking about, they invent a statistically invalid poll.

    This poll only surveyed 700 individuals and a sample size of at least 6,700 ins required. I have a masters degrees in statistics from UC Berkeley.

    Finally, polls or public opinion does not determine truth. This story is sour grapes on the side of the press.

    Why don’t they admit it, they did a horrible job on this story, they presued the mission of advocates, not reporters.

    Shame Shame Shame, did jurors make verdict on a pay check off this dead baby too, ie,,ABC paying 6figures for interview, no justice for caylee, boycot all books,tablods,movies, caylee deserves better than what she got from her mother and jury,hopefully public oppose jury from now on and will be banned from making money off a dead child or anyone else

    This case is just like O.J. Simpson’s. Casey got away with murder. But she
    might as well have fun now because when she’s in front of God, they’ll be
    no Baez to defend her!!!!!!!!!!!!!!!!!!!!The bottom line is someone killed that baby and
    the way I always thought the law was that whoever seen or was with the
    person last….has responsibity. I hate to say this but Kaylee is in a MUCH
    BETTER PLACE!!!!!!!!!!!!
