Woman Accused Of Dropping Child From Window To Be Arraigned

SAN JOSE (CBS SF) -- A woman accused of dropping her 22-month-old child from a second-story window in San Jose on Christmas morning was arrested on suspicion of attempted murder, use of a deadly weapon, and child endangerment, prosecutors said Tuesday.

Charges have not yet been filed against Lupita Cortez, 24, but she is scheduled for an arraignment in court on Thursday afternoon, Santa Clara County District Attorney's Office spokeswoman Lisa McCrary said.

The child suffered only minor injuries, police said.

Officers were called to the 3500 block of Alden Way around 11:30 a.m. on a report that a mother had locked herself into a bathroom with her child, Sgt. Jason Dwyer said.

When police arrived and forced their way into the bathroom, she dropped the child out of a second-story window.

Fortunately, he sustained only minor injuries described as "bumps and bruises," Dwyer said.

Cortez threw herself out the window after her child but also survived, suffering minor injuries to her feet.

She remained in custody at a hospital Tuesday morning, McCrary said.

Dwyer said she is being evaluated for possible psychiatric issues.
