Affidavit Details Domestic Violence Allegation Against SF Sheriff-Elect

SAN FRANCISCO (CBS/AP) — A police affidavit is shedding additional light on the domestic violence allegation against San Francisco sheriff-elect Ross Mirkarimi.

According to the affidavit, the neighbor who reported the alleged domestic violence told investigators she spoke to Mirkarimi’s wife, Eliana Lopez, on New Year’s Day.

Ivory Madison said Lopez told her that she sustained a bruise on her upper right arm when Mirkarimi grabbed her on New Year’s Eve.

Madison also told police she videotaped the injury at Lopez’s request.

The affidavit in support of a search warrant was first obtained by the San Francisco Examiner ( on Friday. Police have seized the video.

Lopez has denied the abuse charges.

The district attorney’s office is reviewing the case but is not expected to make any decisions until next week at the earliest, after Mirkarimi is set to be sworn in as sheriff.

hope that takes the smirk of the Mirk

If this domestic violence case was against an ordinary Joe, he would be in County Jail right now on a felony charge.

    • Just The Facts

Nope. If this were an ordinary Joe a third party complaint of domestic violence doesn’t fly. If the wife does not want to pursue a complaint and testify for the prosecution it will not be prosecuted. District Attorneys do not put hostile victims on the stand for a bruise on the arm.

Just waiting for the “brain tumor” excuse (used by merchandise thief and spouse of an Oakland Superior Court Judge, Mary Hayashi) stating it causes Mirk to sometimes lash out when he’s under the influence of alcohol, but he’s okay now…” defense.

    Bad start ….
    Bad sign ….

Of course he’s innocent until proven guilty. I have a hunch that the PD knows it has to play this one straight. It would be nice for EVERYONE to feel like this was carefully and fairly investigated. Otherwise, we lose more hope.
