SoCal Assemblyman Accused Of DUI In Concord

CONCORD (CBS SF) -- A state legislator from Southern California was arrested on suspicion of driving under the influence in Concord early Tuesday morning, Concord police announced Thursday.

Shortly after 2 a.m. Tuesday, a police officer saw Assemblyman Roger Hernandez, D-West Covina, weaving on the roadway and failing to use turn signals while driving near Concord Avenue and Meridian Park Boulevard, police said.

Hernandez stopped his car in the parking lot of the Crowne Plaza Hotel, and the officer watched Hernandez, "who displayed further objective symptoms of alcohol intoxication," police said in a news release.

The officer performed a field sobriety test on Hernandez and then arrested him on suspicion of DUI.

Police said there was a 29-year-old woman in the car with Hernandez. She was released at the scene, and Hernandez was taken to the Concord Police Jail, where a blood test was performed.

Hernandez was then transported to the Martinez Detention Facility.

Investigators are awaiting the results of the blood test before deciding whether to forward the case to the Contra Costa County District Attorney's Office.
