Assemblyman Charged With DUI Following Concord Arrest
CONCORD (CBS SF) - A California state assemblyman will appear in Contra Costa County Superior Court later this month after being charged with DUI for an alleged drunken driving incident in Concord in March.
Roger Hernandez, D-West Covina, is scheduled to appear in court enter a plea to two misdemeanor DUI counts on May 21, a district attorney's spokeswoman said today.
Hernandez, 36, was arrested March 27 after police saw him around 2 a.m. weaving on the road and failing to use signals while driving near Concord Avenue and Meridian Park Boulevard, according to police.
Blood test results last week showed that Hernandez's blood-alcohol level measured at 0.08 percent, just over the limit for being considered legally drunk.
The assemblyman and assistant majority whip issued a statement last week in which he called the test results "a huge wakeup call" and apologized to his constituents, family, colleagues and staff for his "poor judgment."
Hernandez is set to appear in court in Walnut Creek to enter a plea on May 21 at 1:30 p.m.
