Family Insists San Jose Marine Was Wrongfully Killed By SoCal Police
FREMONT (CBS) -- Friends and family gathered Saturday to mourn the death of a 22-year old San Jose Marine who was killed last week by Palm Springs police. The family believes it is a case of wrongful death.
Allan "AJ" DeVillena II was shot during an alleged confrontation with 2 bicycle officers in a parking garage. DeVillena was unarmed.
The family disputes police allegations that DeVillena was intoxicated and struck an officer with a vehicle, refusing commands to stop. They insist that the veteran, who recently returned from Afghanistan, is being portrayed as a criminal and has no prior run-ins with the law.
DeVillena's father said the family has asked the military investigate his son's death.
