Suspect In San Jose Bathroom Beating Caught On Video Surrenders To Police

SAN JOSE (CBS SF) -- A 41-year-old man turned himself in Friday after being named as a suspect in the assault of an elderly man caught on camera following an alleged indecent exposure incident last week at a park in East San Jose, police said Monday.

Francisco Javier Olivo, of San Jose, surrendered to San Jose police sometime Friday, a day after police reported he was the suspect in a felony assault that injured the elderly male, according to San Jose police Sgt. Heather Randol.

Police filed a report saying that at 7:46 p.m. last Monday, the suspect allegedly slugged the man in a men's room at Fowler Creek Park at Altia Avenue and Cortona Drive, Randol said.

The victim suffered facial injuries from being punched several times before Olivo allowed the man to leave the bathroom, police said.

An associate of Olivo's who was in the restroom at the time filmed the incident. The video was later obtained by police who used it to substantiate that an assault occurred, Randol said.

From the video, police heard that someone allegedly exposed himself to another person in the men's room, which became the motive for the assault, but police have no evidence of an exposure, according to Randol.

Even if an indecent exposure did occur, it would not excuse a criminal assault, Randol said.
