Former 49er C.J. Spillman Was Investigated In Santa Clara Alleged Attempted Rape

SANTA CLARA (CBS SF) - Former 49er special teams standout C.J. Spillman was investigated for groping and trying to force oral sex on a Santa Clara massage therapist while a member of the team last year, according to the New York Daliy News.

The woman claims Spillman pinned her to the ground and was trying to rape her.

The newspaper says - quoting a police report - that Spillman strongly denied the allegations to police when interviewed a few days after the November 2013 incident.

"He acknowledged that he had fondled her through her clothing but said it was consensual and did nothing "forceful." He said he did not demand oral sex," the newspaper reports.

Spillman was never charged as a result of the incident. He was later cut by the team and now plays for the Dallas Cowboys. He is now being investigated in a an alleged sexual assault at the Cowboys' team hotel last month. The team is allowing him to play pending charges being filed in the case.

The 49ers were pulled into the national debate about domestic violence by NFL players - sparked by the Ray Rice assault case - following the August 31st arrest of defensive lineman Ray McDonald. The Santa Clara County District Attorney is reviewing that case. McDonald allegedly hit his pregnant fiancé and police say she suffered "visible injuries."

McDonald's arrest came just days after the NFL decided for harsher penalties against players involved in domestic violence incidents.
