Banned Frosty The Snowman Returns To Pleasanton Christmas Tree Lot Despite Threat Of Fines

PLEASANTON (CBS SF) -- A Pleasanton Christmas tree lot has revived its flattened Frosty the Snowman inflatable figure after the city threatened the lot owner with daily fines for having it up.

On Tuesday, tree lot owner Johnny Moore told KPIX 5 he decided he will fight the fines being threatened by the City of Pleasanton.

The decision came a day after Moore said he was thinking of keeping the snowman up, despite the threat of daily fines.

"Tomorrow, if he's up at one o'clock, there's a $100 fine. And if he's up the next day, it goes to $200. And then the following day I thought he said $500 and it can go up after that. It keeps escalating," he said Monday.

The three-story-tall Frosty is a familiar sight to Pleasanton residents, having been located at Moore's tree lot every December for a quarter-century at the Pleasanton Fairgrounds.

This year, Moore moved his tree lot a few miles from the fairgrounds and on Monday got a ticket from a code enforcement officer saying the inflatable snowman was not allowed at his new location at Bernal Ave. and Stanley Blvd.

Tuesday, Frosty was deflated for a brief time because of the wind and rain. By the afternoon, the inflatable pipe-smoking snowman was back up saluting tree-shoppers with its signature raised mitten.

Later Tuesday, a Pleasanton code enforcement officer came by the location, took a picture of Frosty and then left.
