Student Dumped From Wheelchair Files Lawsuit Against Oakland School District

OAKLAND (KCBS)-- An Oakland High School student who was dumped out of his wheelchair by a campus security guard last year has filed a lawsuit against the school district.

The San Francisco Chronicle reports 18-year-old Francisco Martinez claims he was wrongfully detained when the campus guard cuffed and punched him last May. The suit seeks unspecified damages.

Martinez has cerebral palsy and uses a wheelchair. The incident was caught on surveillance video.

According to the report, school district spokesman Troy Flint said the lawsuit did not surprise him and that the adults in the situation acted "unacceptably" and escalated the situation rather than defusing it.
