Sebastopol Man With Children In Car Arrested For DUI

PETALUMA, Calif. (CBS SF) -- Petaluma police arrested a Sebastopol man on suspicion of driving under the influence and child endangerment Wednesday night after he was seen driving on the wrong side of a road with his three children in his vehicle, a police sergeant said.

Officer Brenden Sawyer stopped Daniel Marquez, 36, after he saw him drive his 2001 Chrysler PT Cruiser east on westbound East Washington Street around 9:20 p.m., Sgt. Ron Klein said.

Marquez turned left onto East Washington Street from Petaluma Boulevard North on the wrong side of the concrete barrier between the east and west lanes, then made a quick turn through an opening in the barrier to get on the correct side of the road, Klein said.

Marquez then accelerated to 40 mph in a 25 mph zone before he was stopped in the parking lot of a CVS store on East Washington Street, Klein said.

Inside the PT cruiser were Marquez's daughters ages 16, 11 and 9, and there were empty beer cans in the back passenger area of the vehicle, Klein said.

Marquez was arrested on suspicion of DUI after allegedly performing poorly on field sobriety tests. A breath test determined he had a blood-alcohol level of 0.20 percent, well over the 0.08 percent legal limit, Klein said.

Marquez did not have a driver's license and was on probation for a prior driving without a license offense and for being under the influence of a controlled substance, Klein said.

He was booked into Sonoma County Jail on suspicion of child endangerment, DUI, driving without a license and violating his probation, Klein said.

Marquez's three daughters were released to their mother, who responded to the scene, Klein said.
