Man Dies From Injuries In San Jose Stabbing Earlier This Month
SAN JOSE (CBS SF) -- A man died Friday from stab wounds he suffered at a San Jose home earlier this month in a domestic violence incident that ended with an officer fatally shooting the suspect, police said Monday.
Richard Shane Fernandez, 38, of San Jose, succumbed to his injuries at a hospital from a stabbing on March 7 at a home on South Third and Martha streets, police said.
The suspect, 45-year-old Byron Rosas of San Jose, allegedly stabbed his estranged wife and Fernandez at the residence, according to police.
Around 6:15 p.m. that day, police dispatch received a report of a person stabbed at the home. An officer, later identified as Don Guess, arrived first on scene minutes after the call was made.
Guess saw the wife and was approached by witnesses, one of whom identified the suspect to him, according to police.
Rosas was armed with a knife, acted "extremely agitated" and didn't follow the officer's commands to drop the weapon as he walked back to the home, where someone was seen outside near the front door, police said.
Guess then shot at Rosas, who was pronounced dead at the scene, according to police.
Fernandez was also located near the home and was transported to a hospital for treatment along with the woman, who was later released, police said.
Fernandez's death marks the city's 10th homicide this year, according to police.
There was a temporary restraining order between Rosas and his estranged wife and a previous domestic violence incident was reported at the home in December in which Rosas was the suspect, police said.
Guess, who has 20 years of experience in law enforcement, was placed on paid administrative leave during the investigation into the shooting, police said.
