Parents Of NorCal Inmate Who Died After Pepper-Spraying Reach $750K Lawsuit Settlement

IONE, Amador County (AP) — The parents of an inmate who died after being pepper-sprayed by prison guards have reached a $750,000 settlement with state and Amador County officials.

The Sacramento Bee reported Monday the attorney representing Joseph Duran's parents sought $6.75 million but the two sides this month agreed to the $750,000 settlement.

Steven and Elaine Duran, the adoptive parents of the 35-year-old mentally ill inmate, filed a lawsuit in federal court in Sacramento following their son's 2013 death alleging that officials violated state law and their and their son's civil rights.

The couple said their son was pepper-sprayed and left unattended inside his cell at Mule Creek State Prison.

It said Duran, who breathed through a tube in his throat, pulled out the tube and that prison officials ignored pleas from medical staff to reinsert it.
