SAN FRANCISCO (CBS SF) -- The San Francisco 49ers have released fullback Bruce Miller after he was arrested and charged with assault after allegedly attacking 2 guests at a San Francisco hotel.

Miller was taken into custody Monday morning, and released later that afternoon.

The incident happened at the Fisherman's Wharf Marriott Hotel on Sunday night, according to authorities.

Miller allegedly punched 2 guests. One guest, a 70-year-old suffered broken bones.

According to San Francisco County Sheriff's deputies, the attack was sparked when Miller tried to check in, and was told the hotel was full.

The 49ers tweeted the team "released" Miller shortly after noon on Monday.

Earlier Monday morning, officials at the 49ers headquarters issued a statement saying, "The San Francisco 49ers organization is aware of the media report regarding Bruce Miller. We are gathering the relevant facts of this matter and will continue to monitor the situation."

Police were being tight-lipped about the case saying it "is under investigation."

Last year Miller plead guilty to a vandalism charge last year after after he smashed his ex-fiancee's cellphone in a San Leandro hotel parking lot. He was originally charged with domestic abuse, as well, but that charge was dropped.
