Judge Reconsiders Death Penalty In California

A federal judge could clear the way for California to once again begin executing death row prisoners. It all hinges on whether the lethal objection process has been improved.

The life Albert Greenwood Brown, convicted of raping and murdering a 15-year-old girl, is in the hands of Judge Jeremy Fogel, the same judge who who shut down the death penalty in the state in 2006, concerned that  the way the lethal injection was administered could be cruel and unusual punishment.

KCBS Janice Wright Reporting:

Government lawyers, with the backing of Attorney General Jerry Brown  argue not only has the procedure been upgraded, but that there's  brand new $835,000 death chamber and better training for staff.  Prison Spokesman Sam Robinson says they're ready to go.

The new center has a separate room for families and witnesses while the inmate would spends the last hours in a has cell with a phone and flat screen TV.

Albert Brown , who called the victim's mother the day she disappeared in 1980, to say her daughter would never be seen again,  could die next Wednesday.
