49ers QB Colin Kaepernick, 2 Other Players Investigated For Suspicious Incident Involving Woman
MIAMI (CBS SF) -- Miami police confirmed Thursday that San Francisco 49er Colin Kaepernick and two other NFL players were mentioned in a police report from a woman who can't explain how she ended up in the hospital after hanging out with the quarterback.
A police report was released Thursday naming Kaepernick, 49ers wide receiver Quinton Patton and Seattle Seahawks wide receiver Ricardo Lockette as being involved in an April 1 incident at Lockette's Miami apartment. The story was first reported by TMZ, which is reporting the incident as a sexual assault.

"While cops only described the situation as a "suspicious incident" -- it's clear they are investigating an alleged sex crime, due to the fact the case was referred to the Special Victim's Office, which handles sex crimes," wrote TMZ.
The woman reported drinking alcohol and smoking marijuana, then feeling light-headed and going to a bedroom to lie down. The woman said Kaepernick, with whom she had a previous sexual relationship, came in and started kissing and undressing her, then "told her that he was going to be right back and left the bedroom," the report states.

The report states that the woman remained in bed naked and Patton and Lockette allegedly "peeked" inside, prompting her to say, "What are you doing? Where is Colin?"
The woman said she can't remember anything after that and woke up in a hospital bed. She said she does not know how she got to the hospital, according to the police report.
49ers general manager Trent Baalke said in a statement that the team is "aware of the recent media report regarding Colin Kaepernick and is in the process of gathering the pertinent facts."
Kaepernick's Instagram account shows he was in Miami last week training, where he posted several photos with the team.
Howard Wasserman, a Professor of Law at Florida International University, said people should not jump to conclusions, as the investigation is in the very early stages.
"They [police] take complaints from people all the time, those complaints are public record, and that's what we have," Wasserman said. "We don't know anything more about what the police are doing with this. We know that they took the report, and we know that they are saying the disposition of the matter is pending, and that's really all we know."
Wasserman said there is no indication in the report of whether the woman suffered any injuries or what led to her being in the hospital.
"There's nothing in the report to indicate that, if they did a rape kit, or any other sort of examination at the hospital. The report is silent to all of that," Wasserman said. "We have a report and we know nothing more about what happened or where it's going from here."
