Mark Estrada, an Oakland resident, was formally charged with first-degree murder with special circumstances Friday ahead of his court appearance.

He was booked on suspicion of murder shortly before 9 p.m. Thursday into Santa Rita Jail and was scheduled for arraignment at 2 p.m. Friday at the Hayward Hall of Justice, according to jail records.

Estrada is accused of killing Hayward police Sgt. Scott Lunger, 48, during a traffic stop near Myrtle and Lion streets around 3:15 a.m.  Wednesday.

Lunger, a 15-year veteran of the department, was shot without warning as he approached the driver's side of a truck that he and another officer had pulled over for driving erratically, police said.

The other officer returned fire at the truck but Estrada managed to flee, according to police.

Estrada allegedly abandoned his truck in East Oakland and ended up at Highland Hospital to be treated for gunshot wounds. Lunger was taken to Eden Medical Center, where he was pronounced dead, police said.

Hayward police said there is surveillance video that may help them fill in the gap between the time Lunger was killed. The video shows a light-colored, four-door sedan with chrome rims seen near Estrada's home in East Oakland early Wednesday morning after the shooting.

Anyone with information about the vehicle is asked to call Hayward police at (510) 293-7034.

Hayward police also said Thursday that the funeral service for Lunger is scheduled for next Thursday at 10 a.m. at the Neighborhood Church at 20600 John Drive in Castro Valley.
