In-N-Out Burger Files Lawsuit Against Delivery App DoorDash

PALO ALTO (KPIX 5) – Known for their Double Doubles, fries and shakes, In-N-Out Burger is suing Bay Area-based DoorDash, over concerns about the freshness of food delivered by the service.

The app allows users to order food from several restaurants that typically don't have a delivery service.

In-N-Out is raising objections because they have no control over how long it takes DoorDash to deliver, saying they can't be sure how long their food will stack up to expectations.

"We have asked DoorDash several times to stop using our trademarks and to stop selling our food," In-N-Out said in a statement. "Prior to filing our lawsuit, we tried contacting them several more times but they never responded to our phone calls or letters."

DoorDash, based in Palo Alto, did not respond to KPIX 5's request for comment Wednesday.
