Former Santa Clara County Deputy Arrested For Allegedly Beating Inmate

SAN JOSE (CBS SF) -- A former Santa Clara County sheriff's correctional deputy was arrested Monday, almost three years after he was accused of kicking an inmate in the head and face while on duty.

Former Santa Clara County sheriff's correctional Deputy Timmy Tri was taken into custody on an arrest warrant for assault with a deadly weapon, in connection to the beating of an inmate on October 3, 2013, according to Santa Clara County sheriff's Deputy Reginald Cooks.

Tri allegedly kicked a male inmate in the main jail in the head and face several times. He was immediately put on administrative leave, Cooks said.

Just under two years after the alleged assault, Tri left the Santa Clara County Department of Corrections, on August 16, 2015.

The investigation into the alleged assault led to the case being filed with the Santa Clara County District Attorney's Office, but the District Attorney declined to pursue the case.

Then, in March, the case was resubmitted to the District Attorney's Office and the office pursued the case, leading to an arrest warrant for Tri.

According to Santa Clara County sheriff's Sgt. James Jensen, Tri is from San Jose and now 35 years old.

Cooks declined to say what new information compelled the District Attorney's Office to seek Tri's arrest and did not say whether any other individuals were involved in the alleged assault.

The mission of the Santa Clara County Department of Correction "is to serve and protect the citizens of Santa Clara County and the State of California, by detaining the people under its supervision in a safe and secure environment, while providing for their humane care, custody and control."

According to Transparent California, which provides information on compensation of public employees in the State of California, in 2013, Tri received pay and benefits totaling over $195,000. In 2014, he received pay and benefits totaling roughly $120,000 and by 2015 his pay and benefits totaled just over $86,000.
