SAN FRANCISCO (CBS SF) – A 19-year-old man was convicted earlier this week of gun and drug charges along with an enhancement for his participation in a criminal street gang, San Francisco District Attorney George Gascon announced Thursday.

A jury found Jacori Bender guilty on Monday of carrying a loaded and stolen firearm, receiving stolen property, and possession of a controlled substance, as well as the gang enhancement, according to the district attorney’s office.

The charges came after Bender was arrested on May 28, 2010, by police officers patrolling the area of Oakdale Avenue and Baldwin Court in the city’s Bayview-Hunters Point neighborhood.

A group of people ran away from the officers, and as the officers pursued, they saw Bender throw away a gun he was holding, prosecutors said.

Bender was arrested shortly afterward and was found to have one ecstasy pill in his front pocket, according to the district attorney’s office.

The weapon was retrieved at the scene, and forensic testing of the gun found Bender’s DNA was on the handle, prosecutors said.

During the trial, prosecutors told the jury that Bender had a history of contacts with the Oakdale Mob gang in the Hunters Point neighborhood, and had previously been convicted of misdemeanor criminal threats.

That conviction came after he was arrested on suspicion of yelling “I’m the Real Oakdale Boy, y’all gonna get blasted up in here,” according to the district attorney’s office.

Bender is scheduled for sentencing on April 8 and faces a maximum of 13 years in state prison.

They only want to make an example of him. Ppl say their for youth but no really is. Some of the obstacles that our youth get themselves in, and in turn put fear in those. That label them.

  2. Mis informed says:

I came from a rough neighborhood and while I did stupid things when young, carrying a controlled substance and running from the Police were not one of them. Especially carrying a stolen/loaded firearm. Let him sit and reflect on his mistakes and allow law makers and police to make more gang injunctions.

He can drop dead as far I’m concern…I grew up without mom and pop but an uncle. I never carry a gun or do drug….and yes I live in a bad neighborhood. Life is no excuse

Yeah, but the gang member was going to kill someone with that gun, not keep it and collect it. Bullets don’t discriminate between who’s a gang member and who’s a productive member of society. i am just glaw enforcement nabbed him before he had a chance to use the gun!

  4. Let him rot says:

I came from the same neighborhood, my mother was a crack ho and I never new my daddy. But I grew up and worked hard delivering the paper, and any other odd job I could find. Then I applied for a student loan, went to college and made something out of myself. Stop making excuses for this low life or anyone else like him.
