HAYWARD (KCBS/CBS SF) – A man, who was shot and killed Friday night at a Hayward gas station parking lot, has been identified as one of the men on the Fruitvale Bay Area Rapid Transit station platform with Oscar Grant, when he was killed on January 1, 2009.

Police found 25-year-old Johntue Caldwell suffering from gunshot wounds in a car at the gas station on West Tennyson Road and Calaroga Avenue around 5:30 p.m.

Officers said he was pronounced dead at the scene.

Investigators said it appears that Caldwell had been sitting in the parked car, when at least one suspect approached him and fired several rounds.

KCBS’ Mark Seelig Reports:

The suspect fled the scene and is still unaccounted for. Police said that they do not believe the shooting was random, although a motive has not been determined.

Oscar Grant’s uncle, Cephus Johnson, was one of many who signed a t-shirt with Caldwell’s face on it at the gas station.

“Johntue was doing nothing wrong in the past two years, especially after the death of Oscar,” Johnson said. “He was in school, he was being a father, he was loving his children, he was spending time with the family.”

Johnson said that Caldwell’s death is just another tragedy that has hit his family.

“When will it end? We have police brutality going on in the communities, we have crimes committed in the community against one another. What is happening?” he asked.

Caldwell was one of several friends with Oscar Grant, when he was shot and killed by former BART police officer Johannes Mehserle on New Year’s Day, 2009.  He was a plaintiff in a related civil suit against BART scheduled to begin next month.

A vigil will be held for him Saturday at 6 p.m. at the corner where he was shot, according to event organizers.

Caldwell was also the godfather of Grant’s daughter, Tatiana, who is now seven-years-old.

      Wow really? someone has lost their life and you can sit her and try to judge the life he lived, and try to justify a killing? This is why things like this happen, because people have no morals. The point is, he was a person, a father, a son, a brother a friend….there is no justification in someone taking anothers life. Its very sad to see the cruelty that exists among us. obviously the ones who speak down on others are the ones that have nothing better to do and obviously dont have fulfillment in their own lives. I feel sorry for you. Regardless of who you THINK he was, no life deserves to be taken, especially at such a young age.

    That’s what seems to be lost on the race baiters in this area: Oscar Grant and his buddies wern’t choirboys on their way to church; they were thugs doing what thugs do which is act up on BART trains. If they hadn’t been acting up to the point where the cops had to be called Oscar Grant might still be alive, although if this guy was his best friend I doubt it. Tell me, will there be massive protests and much hullaballoo made of this man being killed? No. Why? Because the shooter most likely wasn’t white and as long as he wasn’t white there is no reason for anyone to get upset other than the friends and relatives….

So if your answers to those questions weren’t yes then you need not speak on situations you do not know about “mad mike” and even if that were the case and they were acting out that doesn’t give an Bart police officer to kill an unarmed man just because you see a man in a hoodie doesn’t qualify him as a thug !! Hello!!! Maybe you need some help in that area and what does color have to do with anything and why would people go around causing noise behind his friend who was shot at the gas station !         Besides being totally nonsensical I love how you ignore the fact that the cops were called to the BART station because OG and his buddies were FIGHTING on a train but yet that doesn’t make them thugs? If you can’t wrap your cranium around that I have a Golden Gate Bridge I’d like to sell you…and let me ask you “Tiff”, will you be protesting and causing all kinds of commotion until the man who shot Caldwell is found? My guess is no. Because you know damn well most likely another black man shot him and that is just another day in the ‘hood.

        Thugs shooting thugs, this just shows Oscar Grant was a thug, and thugs get shot, you can’t blame this one the Police. Bart Police acted well within their rights, a thug mistakenly got shot with a service weapon instead of a taser, a taser was necessary because Grant was resisting arrest, it was a tragic mistake, but the police did the right thing, attempted to arrest a thug violating the law. You people wonder why this violence occurs, maybe because thugs and people like Tiff protesting when a thug was killed in accident and call the cop a murder!? No it was a tragic mistake, mesherle did not get that morning think he was going to kill a thug, yet the shooter of Grants buddy is a murder who planned on shooting him well in advance and was not provoked into it. Think before you speak, or don’t complain when you or loved ones end up dead because the police don’t want to protect you. I personally am very grateful for cops who put themselves in harms way so my family can enjoy safety.

    There is evidence that employees from DoD, CIA and DOJ accepted bribes from Al Quida.
    If DoJ and DoD employees where more concerned with doing their jobs than enriching themselves by stealing from suspects and taking bribes, then there might have been more a chance that 9/11 had never happened.

    I am sure his family is of the opinion that if their son was going to get shot that it would be by a cop so they could get some money for their grief. Instead it was probably another person like their son who shot him. I do feel for the family as any loss is bad. I do however also hold them somewhat accountable because they allowed him to hang out with the likes of Oscar Grant, scion to the family history of Prison Life.

    The a-hole who commented above obviously didn’t take the time to read that Oscar Grant was in handcuffs on the ground. An unlikely threat to anyone at that point and he begged the cops not to shoot. Policeman are trained and know very well which side their tasers are located and which side their guns are located. Don’t try and wash that sh”t down people’s throat that it was an accident. Also, it amazes me that how Wtes are always trying to justify that because they considered the young man a thug, that the shooting, killing, murder was somehow justified. You people make us sick to our stomach with your flawed thinking. Can someone help us understand whte difference between Enron and other White Collar criminals and these young Black boys you label thugs. Does putting a label on a group of as thugs justify them being killed any more than any other group of criminals engaging in criminalistic behavior seeing as both types are viewed as breaking the law ultimately wreaking havoc unto the public!
