Convicted Rapist May Be Released To Concord Home
CONCORD (CBS SF) – A public hearing has been scheduled in Fairfield to determine if a man convicted of rape and assault should be placed at a Concord home once he is released from custody.
The Department of State Hospitals is seeking to place Fraisure Smith, 51, who is currently being housed at a state hospital, in a single family home, located in the 1500 block of Amhurst Way in Concord, Concord police said today.
The department notified Concord police of the possible placement on Monday, police said.
The public hearing regarding Smith's placement is set for Sept. 25 the Solano County Superior Court in Fairfield.
The Concord Police Department, Concord City Attorney's Office and the Contra Costa County District Attorney's Office will oppose Smith's placement at the Concord residence, according to police.
Members of the public are encouraged to attend the hearing, police said.
In July, Smith was to be placed at a residence on Olive Avenue in Fairfield, as part of the state's Conditional Release Program (CONREP), but the property owner withdrew that location from consideration.
Smith was sentenced to prison in 2006 after he pleaded no contest to assault with intent to commit rape. A jury in 2010 concluded that Smith was a sexually violent predator and Smith was committed to Coalinga State Hospital on July 24, 2010.
Smith filed a petition for conditional release and unconditional discharge in April 2012.
In November 2013, the court ordered him released to CONREP, which then sought a placement that was not within a one-quarter mile of a public or private school with students in grades kindergarten through 12.
On February 23, CONREP recommended Smith be placed on Willotta Drive in unincorporated Solano County near Suisun City, but in April a judge blocked the move because of the residence's close proximity to Solano Community College.
