Suspect, 2 Family Members Wounded In Pittsburg Officer-Involved Shooting

PITTSBURG (CBS SF) -- Pittsburg police Wednesday morning identified a 20-year-old man who was injured when an officer shot him and two of his family members after responding to a domestic disturbance call Tuesday night.

The man, who was hospitalized along with the family members, was identified as Rigoberto Gutierrez. He was the suspect in the domestic disturbance call that officers responded to shortly after 9 p.m. Tuesday, Pittsburg police Capt. Ron Raman said.

Officers responded shortly after 9 p.m. to the 1500 block of Kingsley Drive after a woman said her 20-year-old son was acting irrationally and likely was under the influence of drugs, according to Raman.

The suspect was on the porch of the family's home and demanding to come in, and family members said they could see through a security screen door that he was armed with a gun and pointed it at his father several times, Raman said.

Officers arrived and gave verbal commands to the suspect, who refused to comply. When he allegedly reached for his firearm in his waistband, an officer opened fire, striking him in the leg.

The family members who got injured were standing behind a locked security screen door when police showed up to confront Gutierrez.

"He was given commands to show his hands. He did not. He immediately reached for the firearm," said Raman.

Police shot at Gutierrez at least five times, hitting him in the leg. Two rounds went through the door struck his father in the torso and 17-year-old brother in the leg.

"Unfortunately, they were struck as a result of his actions," said Raman.

All three were hospitalized but are expected to survive. The father has since been released and the 17-year-old is in stable condition.

Raman said Gutierrez will be booked into county jail on suspicion of assault with a deadly weapon and other weapon-related offenses once he is medically cleared. The suspect's handgun was recovered at the shooting scene.

The officer involved in the shooting has 20 years of law enforcement experience, Raman said. The officer's name was also not immediately being released.

The shooting is being investigated jointly by Pittsburg police and the Contra Costa County District Attorney's Office.
