Judge Says California Must Release Papers Discussing Risk Of Cellphone Use

BERKELEY (KPIX 5) — California could have to hand over some documents on cellphone use it tried to keep under wraps.

On Friday, a Superior Court judge said the state must release papers discussing the possible risks of long-term cellphone use.

UPDATE 3/13/17: The judge issued her final ruling. The “document advising the public of the risks of Electromagnetic Frequencies (EMF) associated with Cellular Phones” is a public record and must be turned over to the public. 

Following the tentative ruling in February, the state released a redacted copy of the document. This ruling orders the state to release an un-altered version in its original form. 

The documents were written by the state’s Environmental Health Investigations branch and are believed to contain cellphone radiation warnings and recommendations for public use.

But the state refused to hand them over when requested by a director at University of California, Berkeley School of Public Health.

So Joel Moskowitz, Ph.D., sued the state under the California Public Records Act.

Moskowitz, Director at the Center for Family and Community Health at UC Berkeley’s School of Public Health explained to KPIX 5 the reason he sued. “I would like this document to see the light of day because it will inform the public that there is concern within the California Department of Public Health that cellphone radiation is a risk, and it will provide them with some information about how to reduce those risks.”

When asked why he thinks the state is trying to suppress this document, he said, “They claim that this would lead to chaos and confusion among the public, I suspect that they were afraid of the reaction from the telecommunications industry should they publish this document. In fact, they even argued that in their brief.”

In a tentative ruling Friday, a judge found the documents are, in fact, public record and the public should have a right to see it.

The judge stated that there is significant public interest in DPH’s investigation into risks associated with cellular phone use and advising the public as to those risks.

Moskowitz cites new research that finds a significant relationship between cellphone use of 10 or more years and increased brain tumor risk.

The Department of Public Health would not comment on the ruling or if it intends to release the documents. Lawyers note they could appeal.

The FCC says there is no evidence of a “definite link between wireless devices and cancer or other illnesses.”

But, Moskowitz, who believes cellphones do pose health risks and urges users to limit their contact with them, hopes the ruling will at least help call attention to the issue.

    Cell phones use less power, but use higher frequencies comparable to microwave ovens. I would use hands free devices or the speaker phone and not stick it next to your head if possible!

    Regardless of the findings — telling the average person to limit their cellphone use will be as effective as the “just say no” anti-drug campaign. We are too far gone in our addiction.

    Just another example of the scientifically under educated public. An elementary knowledge of radiation physics would inform you the type of radiation emitted by cell phone devices can hardly penetrate a few layers of skin.

  8. I use the phone on “speaker” and hold it in front of my mouth. Radiation energy drops by the inverse square of the distance. Double the distance and 1/4 the power density. It’s not much to begin with in modern digital phones. The old brick phones were analog and a significant higher power output as indicated by their massive batteries.

    The brain tumor is glioblastomia it is the most aggressive of any tumor, and their is NO cure, because receiving radiation treatment for a tumor caused by radiation, is NO way to treat this thing. Chemo same outcome, it doesn’t work, just excels the situation.

  14. Cellphones have been investigated (for alleged cancer risks) for years. A Swedish study years ago found no increased risks. I am sure the lawyers and courts will find otherwise.

  23. I’m no expert, but I’ve been using cell phones 30 years. The oldest phones, you wouldn’t want anywhere near you and they weren’t. The antennas were attached to the roof of your car and they had so much power you could probably call the moon on a clear night. LOL These were 3 watt phones.

    Today? They’re .6 of one watt power or less. That’s very little comparatively speaking. Next to your head? I seriously doubt there’s much to worry about there. Unless, of course, like anything else, you abuse it and live on it. Texting itself is no worry because the unit isn’t even close to your head. So it’s just talking and not much of that is really done with the modern phones. Just go by a school when it lets out. They’re all on the phone, but texting to social media. Not talking on them.

    When you consider that today everything is wireless, you’re body is being bombarded by RF on a continual basis. Your Microwave, your WiFi (2 or 3 different frequencies), your cordless home phones, your TV, some refrigerators use wireless for their temperature sensors. Even my automatic toilet flusher is wireless. Cell Phones are just a small part of this.

  26. Warnings to reduce exposure to children have been out for over a decade. Dr. Devra Davis, founder and president of the Environmental Health Trust, and Dr. Ronald Herberman, founding director of the University of Pittsburgh Cancer Institute, issued recommendations in 2007 calling for reduced exposure and providing precautionary advice.

    In 2008, Dr. Herberman presented a report to the oversight and government reforrm committee titled “Tumors and Cell Phone use: What the Science Says.” In addition, Dr. Herberman presented advice regarding cell phone use in a memo to his staff in 2008, stating, “Do not allow children to use a cell phone, except for emergencies. The developing organs of a fetus or child are the most likely to be sensitive to any possible effects of exposure to electromagnetic fields.”
