Standing in a black suit near the defense table, Naso, 79, of Reno, said, “I am not the monster who they say killed these woman. I don’t kill people, and there is no evidence of that in my writings or photography.”

He called the prosecution’s case a combination of theory, speculation and opinion.

“You will see none of this evidence will surface,” Naso told 19 jurors, including nine alternates, at the trial that is expected to last until November in Judge Andrew Sweet’s courtroom.

Naso, a former commercial photographer, is representing himself but has an advisory counsel to help him with questions of law and judicial proceedings.

“If I was guilty, I would have to hire the two or three best attorneys in the Bay Area,” Naso told the jury.

On Monday morning Deputy District Attorney Rosemary Slote outlined the prosecution’s case during her 97-minute opening statement.

She said Naso’s DNA was found on epithelial cells on the pantyhose of victim Roxene Roggasch, 18, of Oakland whose body was found on White’s Hill off St. Francis Drake Boulevard near Fairfax on Jan. 11, 1977.

“It’s not a match, it’s a theory. There’s no conclusive evidence,” Naso said.

The DNA of Naso’s wife Judy was found on pantyhose that were wrapped around Roggasch’s neck, Slote said.

Another victim, Carmen Colon, 22, was living in a San Francisco apartment when she disappeared, Slote said. Her body was found in Contra Costa County on Aug. 15, 1978.

The body of Tracy Tafoya, 31, was found near Marysville Cemetery in Yuba County on Aug. 14, 1994, and the body of Pamela Parson, 38, of Linda in Yuba County was found on Sept. 19, 1993.

All four women worked as prostitutes, and Tafoya, Parsons and Roggasch were strangled, Slote said. Colon’s body was too decomposed to determine a cause of death.

Naso lived in Oakland less than three miles from where Roggasch and Colon worked as prostitutes, and later in Yuba County not far from where Parsons’ and Tafoya’s bodies were found, Slote said.

“I have no issues with prostitutes. I have high regard for them,” Naso told the jury.

He said he had contact only with Parsons as a photographer who liked to pose women in exotic “pin-up, cheesecake” poses.

“She did modeling for me. I’m sorry about her demise, but I didn’t do it,” Naso said.

He said there is no evidence he was with any of the four women the last time they were seen alive.

Slote also told the jury there were references to the four women in a “list of 10″ found in Naso’s safe deposit box at a Reno bank.

Written on the list were “girl from Port Costa, girl from Logunites (sic), girl from Linda (Yuba County) and girl from MRV (Cemetery).

Naso told the jury the list is “vague” and doesn’t include names.

“It’s just a piece of paper with a general location. There’s not

even a year,” Naso said.

Five other entries on the list of 10 were redacted, but entry No. 8, “girl in Woodland, Nevada County” might refer to a woman named Rene Shapiro, who changed her name after she was adopted by the Shapiro family to “Sara Dylan,” the name of musician Bob Dylan’s ex wife.

She was a huge Bob Dylan fan and she attended his concert tours all over the world. She was last seen at a Dylan concert in Hawaii in April 1992, Slote said.

In 1998 a skull was found in Nevada County near the Placer County border, Slote said.

Slote said a passport with the name Sara Dylan and a photo were found in Naso’s safe deposit box at a Reno bank.

Investigators located her birth mother, who had given her daughter up for adoption to the Shapiro family in Texas, Slote said.

The DNA from the skull found in Nevada County matched her birth mother’s DNA, Slote said.

Naso told the jury no one saw Sara Dylan leave Hawaii in 1992, arrive on the mainland or saw her alive in California.

He said the fact the passport was found in his safe deposit box does not link him to her death.

He also told the jury he often finds clothing and identification papers when he goes “Dumpster diving” after flea markets.

“I’m a pack rat,” he said.

Slote said prosecutors learned about Sara Dylan and the skull in

Nevada County about six months ago, and they have not charged Naso with her death because there would then be another preliminary hearing which would further delay the trial.

She said she mentioned the Sara Dylan passport in her opening statement “for identity purposes” and would not comment further.

Naso said he would like the jury to find him not guilty so he can “get his life back, go back home and see my children.”

“I don’t know where or why they were murdered. We don’t know if they were done by the same person. There are a lot of unanswered questions. Don’t buy it unless there’s real good evidence,” Naso said.

The trial resumes Tuesday morning. There are no trial sessions on Thursdays.

Felicia Anderson, who has been driving Muni buses for 14 years, was operating a 19-Polk bus when the shooting occurred around 2:15 p.m. on June 6 near 25th and Wisconsin streets.

The 22-year-old victim was near the back of the bus and was grazed on the left side of his head by a bullet, police said.

Instead of waiting for medics to arrive, Anderson drove the victim directly to nearby San Francisco General Hospital, where he was treated for injuries that were not life-threatening, according to police.

At an event near AT&T Park Monday, Mayor Ed Lee said Anderson “acted way beyond the call of her daily duties.”

San Francisco Municipal Transportation Agency director of transportation Ed Reiskin said she showed quick thinking and “extraordinary action in the spur of the moment.”

Anderson said she heard the gunshots and then was told by a passenger that someone onboard was shot.

“My first concern was to get him to safety, him and myself and the other passengers,” she said. “That was the first thought, was to get him to the hospital because we were so close.”

Anderson said the shooting was the first on one of her buses “and hopefully the last.”

She said she didn’t get too stressed out in the aftermath of the shooting.

“My mother said I was born calm, so I’m always calm, I don’t get too excited,” she said.

Police said three suspects connected to the shooting got onto the bus, then got off a short time later and opened fire.

No arrests had been made in the case as of Monday afternoon, police said.

The Rangers had scored only eight runs during what was the longest active skid in the majors, and all six losses came at home.

Cruz’s second homer was a two-run shot onto the hill in straightaway center field on an 0-2 pitch from Jesse Chavez (1-1) in the fifth. Cruz thrust his right arm into the air and shouted out while rounding the bases on his 18th homer of the season. It came right after Pierzynski’s RBI double and put the Rangers up 7-6.

Cruz added a run-scoring double in the seventh and matched his season high with four RBIs.

Oakland, which entered the four-game series opener with a three-game lead over the Rangers in the AL West, wiped out an early 3-0 deficit with a six-run fourth ignited by a bizarre play.

Neal Cotts (3-1) went 2 1-3 perfect innings in relief of rookie Nick Tepesch. Robbie Ross and Tanner Scheppers each worked 1-2-3 innings, then Joe Nathan gave up a run before securing his 21st save in 22 chances.

After being held to two runs or less in a team record-matching six games in a row, the Rangers took care of that streak in the first three innings. Pierzynski pulled a two-run homer off the right-field foul pole in the second, an inning before an RBI double by Ian Kinsler. That was Kinsler’s first hit in 10 at-bats since coming off the disabled list Saturday after missing 25 games with a rib cage injury.

The Rangers’ eight runs and 12 hits were both their most in 16 games this month.

Cruz, who had his 10th career multihomer game, hit a solo shot in the fourth.

In the Oakland fourth, Yoenis Cespedes hit a grounder that ricocheted off third baseman Adrian Beltre toward shortstop. Elvis Andrus was about to throw to first when he saw John Jaso running in front of him toward third.

Andrus threw to Beltre, who made a swiping attempt at a tag. Jaso, sliding headfirst in front of him, lifted his arm into the air to avoid the tag and then dived into the base with his left hand. He was called safe by third base umpire Jordan Baker even though it appeared his hand came off the bag while being tagged. Beltre was irate and manager Ron Washington even came out to argue the call.

Tepesch then allowed three hits and a walk to the next four hitters, including a two-run single by Seth Smith, who scored on Jed Lowrie’s double. Eric Sogard had a sacrifice fly and Coco Crisp’s RBI single made it 6-3 and chased Tepesch.

Oakland rookie Dan Straily had a 2.21 ERA in his previous five starts, a stretch that began at Texas on May 21 when the right-hander worked seven scoreless innings and faced 22 batters — one more than the minimum for that span — in a 1-0 win over Yu Darvish.

Straily hadn’t allowed a homer in his last six starts and 38 innings until Pierzynski went deep. The first of Cruz’s two homers came off him.

Cruz was the first batter faced by Chavez when he took over for Straily, who allowed six runs and eight hits over 4 2-3 innings.

The bicyclist was found lying in East Taylor Street west of state Highway 87 at 3:25 p.m. He was pronounced dead at the scene.

Police Sgt. Jason Dwyer said that the bicyclist had been struck by a vehicle whose driver then left the scene.

Police have not located any witnesses to the collision.

“We really don’t have much to go on except that it’s a hit-and-run and we’d like the public’s help,” Dwyer said.

All westbound lanes of Taylor between Highway 87 and Coleman Avenue were closed as police investigated.

Warren George, of the Prison Law Office, said 18 inmates died in 2012 and January 2013 from complications relating to the fungus that causes valley fever and more inmates would die if the court waited any longer. “It will go on, delay means more death,” George said.

But Walter Schneider, an attorney representing the state Department of Corrections and Rehabilitation, told U.S. District Judge Thelton Henderson that the U.S. Centers for Disease Control and Prevention and National Institute for Occupational Safety and Health should be allowed to complete a study of the issue before the court orders the transfer of 3,250 of 8,100 inmates at the prisons. Schneider said the study would be finished by December.

The judge made no immediate ruling Monday.

California Gov. Jerry Brown’s administration has argued in court filings that it is impractical to move so many inmates while the state struggles to comply with another federal court order requiring it to reduce prison crowding statewide as a way to improve conditions for sick and mentally ill inmates.

Nearly three-dozen inmate deaths and hundreds of hospitalizations at Avenal and Pleasant Valley state prisons have been blamed on the fungus that causes valley fever. About half of the infections from the fungus produce no symptoms, while most of the rest can produce mild to severe flu-like symptoms. In a few cases the infection can spread from the lungs to the brain, bones, skin or eyes, causing blindness, skin abscesses, lung failure and occasionally death.

Medical studies have found that black, Filipino and medically at-risk inmates are more vulnerable to health problems from the illness, which is a fungal infection that originates in the region’s soil. The disease is not known to spread from person to person.

The CDC says the number of valley fever cases rose by more than 850 percent nationwide from 1998 through 2011. Valley fever cases in California rose from about 700 in 1998 to more than 5,500 cases in 2011, with the biggest increase in the region where the two prisons are located.

Since 2005, the corrections department has known about what the experts called a “medical and public health emergency” at the two prisons, which sit about 10 miles apart and 175 miles southeast of San Francisco.

The state thwarted a previous study by the CDC in 2008 and balked at spending $750,000 for improvements at one of the prisons in 2007 because of the high cost. Yet the experts noted the state spends more than $23 million annually to treat inmates hospitalized with valley fever

The federal court-appointed official who controls prison medical care, J. Clark Kelso, has said that inmates who are particularly susceptible to the disease should be moved out of Avenal and Pleasant Valley state prisons.

Kelso and three court-appointed medical experts argued in court filings last month that the state’s resistance not only is potentially deadly to vulnerable inmates, but demonstrates that California is not yet ready to retake control of inmate medical care in the state’s 33 adult prisons.

The corrections department has already upgraded all its air filtration systems in the prisons’ housing units and provided the staff and inmates additional medical training, Schneider said. He said the state is already in the process of transferring out certain high-risk inmates.

The state wants to move about 600 medically high-risk inmates out of the two prisons by August while experts study whether other steps can cut down on the dust that carries the fungus. That includes covering dusty areas, keeping more dust from entering buildings and giving surgical masks to inmates and employees who request them.

SAN FRANCISCO (KCBS) — Police in San Francisco have rearrested a man who allegedly harassed passengers while naked at the 16th Street BART station in an incident caught on video last month.

The San Francisco District Attorney’s office told KCBS that 24-year-old Yeiner Perez is scheduled to be arraigned Tuesday afternoon on two counts of false imprisonment, four counts of battery and one count of sexual battery.

Authorities link Perez to a May 10th incident in which a naked man was caught on a cellphone video performing flips and handstands on fare gates at the station. The man in the video is also seen harassing several passengers and station employees.

Police originally arrested Perez and took him to the hospital for psychiatric evaluation, but released him without filing charges. He was then taken into custody by Immigration and Customs Enforcement officials who said that he might be facing deportation back to Colombia.

The acrobat has also been fired from the East Bay performance troupe Clownsnotbombs.

Perez is being held in San Francisco County Jail as of Monday, with bail set at $100,000.

Jurors heard the victim, who is about 5’4” and a little over 100 pounds testify in court that she was even smaller and lighter when she was gang raped on the campus of Richmond High in October 2009.

She told the prosecuting attorney that she suffers from headaches, her right rotator cuff on her shoulder pops out on occasion and so does her hip. She has scars on her back where her assailants were putting out their cigarette butts.

She testified that she was leaving a homecoming dance when she met up with a childhood friend who asked her to join him and a few other friends on campus.

She said she made some small talk and remembers standing up to leave. Next thing she knew, she was waking up in the hospital with pain from head to toe.

Suspects Jose Montano and Marcelles Peter are among six people accused of raping the victim, who was 16 at the time. Authorities said she was beaten, robbed and sexually abused over two hours while as many as 20 people watched.

Her blood-alcohol content was .35, a near fatal amount, but she told the prosecutors she had no recollection of drinking. Her statement had conflicted with what she told police.

She said she has no memory of having sex with anyone, but she remembers getting kicked in the stomach and falling.

The victim’s testimony was in a very matter of fact tone and she showed very little emotion.

SAN FRANCISCO (CBS SF) — Caltrain service was shut down Monday evening as police talked a man with a knife down from a ledge near Caltrain’s 22nd Street station in San Francisco, police and Caltrain officials said.

Police responded to a call reporting a man with a knife near the intersection of 22nd and Iowa streets, police Officer Gordon Shyy said.

The man in his 20s was not compliant with officers and climbed onto a ledge, prompting police to shut down the area, including Caltrain service.

Shortly before 6 p.m., police said hostage negotiators had talked the man off of the ledge.

Caltrain spokeswoman Christine Dunn said Caltrain tracks through San Francisco reopened shortly after 6 p.m. but that service delays will continue for some time.

Some northbound trains carried riders to the Millbrae station, where they could take BART. Caltrain tickets are being honored on BART Monday evening.

SAN JOSE (CBS/AP) – Lowe’s executives said Monday that they plan to expand the company’s California presence with an acquisition of Sears spinoff Orchard Supply Hardware Stores for about $205 million in cash.

San Jose-based Orchard Supply filed a voluntary Chapter 11 bankruptcy petition on Monday, so the offer from Lowe’s will become the “stalking horse” bid for an auction of Orchard’s assets.

The “stalking horse” bid sets the floor for an auction process that lets competitors make better offers.

Lowe’s Cos. Inc. said it will acquire at least 60 of Orchard’s 91 stores, and alternative bids must top Lowe’s offer by at least $12 million.

Orchard stores are smaller than Lowe’s locations, and they are mostly in densely populated California markets. The San Jose company was spun off from Sears Holdings Corp. in January 2012.

SAN FRANCISCO (KPIX 5) – San Francisco police hope someone recognizes the two young women seen carrying out a mugging on a San Francisco Muni Train last week.

In surveillance footage released Monday, the women approach a seated 67-year-old, punching her in the face and then taking off with her purse and cell phone.

The attack happened last Tuesday evening near 3rd and Carroll Street aboard the T-3rd line.

Anyone with information is asked to contact SFPD.

PETALUMA (CBS SF) – A two-alarm vegetation fire outside of Petaluma has been contained to about 20 acres, a Rancho Adobe Fire Protection District spokesman said.

The fire, initially reported at 5 acres, was reported in the 1100 block of Thompson Lane at 3:23 p.m., spokesman Dave Welch said.

The blaze spread to 20 acres and was bumping up against residences, Welch said.

As of 4:45 p.m. he said no buildings had been damaged, however residents on Thompson Lane, Skillman Lane and Magnolia Avenue were notified about the blaze and told to shelter in place.

He said an official evacuation order was not called.

Vogelsong broke two bones in his right pinkie area and also dislocated a knuckle in the hand on a swing May 20 and underwent surgery the next day. He had five pins inserted in his hand during the procedure at Stanford, performed by orthopedist Dr. Tim McAdams. He will examine Vogelsong on Tuesday at AT&T Park.

“Other than waving a magic wand to make it heal, we’re doing the right things,” Vogelsong said Monday, before the opener of a three-game series with San Diego.

The expected recovery time is six to eight weeks until Vogelsong is pitching again, but he likely would need a rehab assignment before re-joining the Giants.

Vogelsong said that if an X-ray on Tuesday shows increased healing, he could have a couple of the pins removed and begin additional mobility exercises. The pins poke through Vogelsong’s skin beneath a protective brace.

“Hopefully there’s some pins coming out tomorrow,” he said. “That’s the plan, but obviously I don’t know for sure until I get some X-rays tomorrow and see how things are healing. It’s good news, but I’m a little worried about getting pins pulled out of my hand. It’ll be a good thing. I’ll get over it. I should be able to start moving it around a little bit more.”

The journeyman Vogelsong, a 2011 All-Star who received an $8.3 million, two-year contract in January 2012, was hurt on a swing when he chased an inside fastball from Washington’s Craig Stammen during an 8-0 victory against the Nationals last month.

He is 2-4 with a 7.19 ERA in nine starts this season, but was injured during his best outing of the year. Vogelsong won three games during the postseason last fall for the World Series champion Giants, including one during a 4-0 sweep of the Tigers for the team’s second championship in three years.

Though financial details were not disclosed, Netflix Inc. said the agreement includes more than 300 hours of new TV episodes in a multi-year deal. Analysts estimated the contract could be worth several hundred million dollars over time.

The transaction is a major coup for both companies. It helps Netflix compete with pay TV channels such as HBO and Showtime, and it gives DreamWorks a potentially lucrative outlet for its shows as it tries to shed its reliance on two or three big-budget movies each year.

“This is arguably a groundbreaking deal,” said Tuna Amobi, a Standard & Poor’s equity analyst who covers both Netflix and DreamWorks Animation SKG Inc.

While concerns remain about how much the deal will cost Netflix in the end, the company said it can debut the original series in the 40 countries where Netflix operates. That could help spread the costs over more territories and more subscribers if Netflix continues to grow overseas.

“The big question is if this is going to be an international catalyst in terms of subscriber growth,” Amobi said.

Investors hailed the deal as a win-win. Netflix shares rose $15.24, or 7.1 percent, to close at $229.23 on Monday, while DreamWorks shares rose 93 cents, or 4 percent, to close at $23.74.

Netflix is doubling down on original children’s programming, hoping to strengthen its push to become a family entertainment brand. The new content should ease some of the pain of losing a range of kids shows from Viacom Inc.’s Nickelodeon network, including future episodes of “Dora the Explorer,” which Amazon.com Inc. snapped up for its streaming service in early June.

The deal suggests DreamWorks will significantly ramp up its production of TV shows. Currently, it only produces “Dragons: Riders of Berk” for Cartoon Network, which completed a run of 20 episodes at 23 minutes each – less than 8 hours of content in all – in March.

A second season of “Dragons” is set for release in the fall, and Netflix had already contracted with DreamWorks for a series based on its upcoming film, “Turbo.” But the deal suggests that several new series will have to debut each year to fulfill the industry standard deal length of five to seven years.

New series will be based on characters either from future film hits, past franchises like “Shrek,” or even older hits, including the hundreds of characters like “Casper the Friendly Ghost,” which DreamWorks acquired when it bought Classic Media last July for $155 million.

The new DreamWorks shows aren’t likely to tread on ground already covered by its existing TV shows, according to DreamWorks spokeswoman Allison Rawlings.

DreamWorks already licenses characters from “Kung Fu Panda,” “Madagascar” and “Monsters vs. Aliens” to Viacom’s Nickelodeon, which has been producing original animated TV shows based on those movies since 2008.

The multi-year agreement tops the undisclosed amount Netflix spent on “House of Cards,” the political drama starring Kevin Spacey that debuted to rave reviews on Netflix in February.

Netflix has been adding original programming to its roster of older movies and TV show reruns, and is set to launch the Jenji Kohan-created “Orange Is the New Black” next month. The company has said that for the next several years, it will contain original content spending to within 10 percent of its $2 billion in annual content costs.

Netflix’s increased focus on children’s programming is seen as a departure from the tactics of traditional premium pay TV channels such as HBO, Starz and Showtime, whose original shows tend to be tailored to adults. It also ramps up the competition for children viewers with Amazon, which said last month it will produce three new original kids shows for members of its Amazon Prime subscription plan.

Netflix has said it has 29.2 million streaming video subscribers in the U.S. and 7.1 million internationally as of the end of March. Those figures are up 5.8 million and 4.1 million respectively from a year ago.

In December, Netflix announced it will offer Disney movies, starting with films released in 2016. It declined to make a similar deal for the rights to Sony movies starting in 2016, which was kept by Starz.

Investor reaction wasn’t uniformly positive. Analyst Rich Tullo of brokerage Albert Fried & Co. said he doubts that DreamWorks has the capacity to produce more than one or two new series a year.

“It’s physically impossible without this content being spread out over 10 years,” he said.

Hit TV shows aren’t guaranteed, and it’s not clear that this will make up for Netflix’s loss of Nickelodeon content, he said.

“Are they going to lose 2 million subscribers off losing Nickelodeon content? That’s possible too,” he said.

Netflix has gradually been shifting where it spends money – preferring exclusive and original content over shows that appear elsewhere, as was the case with content from Starz and Viacom. It let both of those deals lapse.

The company studies the viewing habits of its subscribers to gather insights into whether the programming is likely to be a hit on its service, and how much to pay for it. But not all of its picks have been winners.

After “Arrested Development” debuted last month, Netflix’s shares dropped more than 6 percent because critics had mixed reviews. Monday’s gains more than made up the lost ground.

The company, like some other businesses, had asked the U.S government to be able to share how many requests it received related to national security and how it handled them. Those requests were made as part of Prism, the recently revealed highly classified National Security Agency program that seizes records from Internet companies.

Prism appears to do what its name suggests. Like a triangular piece of glass, Prism takes large beams of data and helps the government find discrete, manageable strands of information.

Prism was revealed this month by The Washington Post and Guardian newspapers, and has touched off the latest round in a decade-long debate over what limits to impose on government eavesdropping, which the Obama administration says is essential to keep the nation safe.

Apple Inc. said that between 9,000 and 10,000 accounts or devices were specified in data requests between Dec. 1, 2012, and May 31 from federal, state and local authorities and included both criminal investigations and national security matters.

It said that the most common form of request came from police investigating robberies and other crimes, searching for missing children, trying to locate a patient with Alzheimer’s disease, or hoping to prevent a suicide.

The company also made clear how much access the government has.

“We do not provide any government agency with direct access to our servers, and any government agency requesting customer content must get a court order,” Apple said in a statement on its website.

Apple explained that its legal team evaluates each request and that it delivers “the narrowest possible set of information to the authorities” when deemed appropriate. The company said that it has refused some requests in the past.

Facebook Inc. has said that it received between 9,000 and 10,000 requests for data from all government agencies in the second half of last year. The social media company said fewer than 19,000 users were targeted.

Apple’s stock rose $2.12 to $432.17 in morning trading on Monday. They have traded in a range of $385.10 to $705.07 over the past 52 weeks.

With only 42 percent of Oakland’s third graders reading at grade level, the project aims to improve that figure to 85 percent by the end of the decade.

“All of Oakland deserves to read,” Quan said at a briefing with outgoing Oakland Unified School District Superintendant Tony Smith. City council members Libby Schaaf and Dan Kalb were also at the news conference at the Oakland Marriott City Center, as well as State Assemblyman Rob Bonta.

Quan said students who are not prepared to read in third grade are 13 times more likely to drop out of high school. She said poor reading skills can affect children for life, hurting their ability to get a job and making them more likely to become involved in crime.

“If kids do well in school, they will have more hopes and dreams,” Quan said.

Smith, who will be leaving his superintendent post by the end of the month, said the 85 percent reading readiness goal can only be achieved if everyone — from the mayor’s office to parents to the public housing authority — shares the responsibility.

He emphasized the importance of school attendance, which he noted boosts school funding and is correlated to academic success.

“In order to be successful in school, they have to be at school,” Smith said. “We’ve got to get the little ones to school.”

Oakland parent Charles Allensworth said the community needs to step in and support the project.

“The more that we give, the more our children will benefit from our efforts,” he said.

So far, Oakland Reads 2020 has received $700,000 in private funding from the Rogers Family Foundation, Kenneth Rain Foundation, and the East Bay Community Foundation.

The effort continues to be supported by almost 100 other private and public entities, including the City of Oakland and OUSD. Program organizers are looking to secure more funding at the city, state, and federal levels.

The initiative is part of the National Campaign for Grade-Level Reading.

“If you know you want a certain size and look to a dog then breed is the way to go. If you’re looking for a particular behavioral trait, then things get fuzzy. The reason for that is, over the years breeders have bred for the look of the dog and de-coupled it from its function and behavioral traits,” she said.

Scarlett explained that breed in dogs is similar to race in humans and that what is known is that we’re more genetically alike than we are different.

Dogs have 20,000 genes according to Scarlett and that only about one percent of those make up the look of the dog, but it’s the behavior part that is more of a “complex genetic puzzle” that hasn’t been figured out.

Even animal experts can have a difficult time determining a dog’s breed simply based on physical appearance. Recently a researcher took mixed-breed dogs, or mutts, and DNA tested them to see what breeds were in them. Then veterinary professionals and other animal experts were then asked to predict what breeds were in the mutts. According to Scarlett, most of the experts, including herself failed miserably.

“This is important because we make a lot of medical decisions based on the fact that we think that it’s part boxer or spaniel and we also make decisions in shelters about who to put up based on how they look.

Mayor Ed Lee and other city officials were on the new bus waiting to be taken to City Hall after a news conference at Pier 48 near AT&T Park when the mishap occurred.

The bus could not be driven away, and the mayor and the rest of the group had to be ushered onto another bus. Muni spokesman Paul Rose said it appears there was an issue with the bus’ hydraulic system.

Crews were initially looking at the bus’ hydraulic system as the source of the problem, but later determined that a sensor was incorrectly showing that the rear door of the vehicle was open, which prevented the bus from driving away, Muni spokesman Paul Rose said.

The problem has since been resolved and crews will check the rest of the new buses to make sure similar issues don’t pop up, Rose said.

The vehicles are part of a fleet of 62 new biodiesel-electric hybrid buses being introduced into the Muni system, which has not had any new buses since 2007, agency officials said.

Beginning this month, Muni will deploy the new hybrid buses, part of a five-year plan to replace the current fleet of buses with 62 new hybrids, according to officials.

The new buses were expected to bring clean, brand-new vehicles that use state-of-the-art hybrid and biofuel technologies to make one of the cleanest bus fleets in the nation, officials said.

In addition to the unveiling of the new buses, Mayor Lee honored Muni operator Felicia Anderson.

Anderson was the driver of the Muni bus who transported an injured passenger directly to a hospital after a shooting aboard a 19-Polk bus earlier this month.

SAN JOSE (KCBS) — A car crash that killed one person in San Jose early Monday morning occurred shortly after the car’s two occupants allegedly stole beer from a 7-Eleven store about a mile away, police said.

The crash was reported at 2:01 a.m. in the area of Hillsdale and Pearl avenues, near state Highway 87, police said.

The driver, whose identity is still being determined, had been headed south on Pearl in a gray-colored Toyota Avalon at a high rate of speed, police said.

He apparently tried to turn onto Hillsdale but lost control and crashed into a parked car, causing a chain reaction that involved a total of five parked cars, police said.

A man who was riding in the Toyota as a passenger was pinned inside the vehicle, and personnel from the San Jose Fire Department had to extract him, police said. He was pronounced dead at the scene.

The driver was taken to a hospital with injuries that were not life-threatening, police said.

Investigators believe alcohol was a factor in the accident and plan to arrest the driver for misdemeanor and felony DUI, as well as vehicular manslaughter with gross negligence, police said.

Prior to the crash, the driver and passenger had allegedly taken some beer from a 7-Eleven store at Branham Lane and Pearl Avenue and left without paying for it, police said.

The passenger’s name is being withheld until his family has been notified of his death, police said.

This season’s winner is Pittsburgh Penguins’ center Sidney Crosby.

Crosby wins his second Lindsay Award after posting 56 points in just 36 games, before breaking his jaw and missing the team’s final 12 games.

“It is nice to be recognized by the guys that you play against,” Crosby said. “I think it’s obviously a compliment.”

The Penguins’ captain returned to the form he had reached before his concussion issues began at Heinz Field during the Winter Classic in 2011.

“I was well rested,” Crosby joked. “I got [back] to the level that I wanted to.”

Crosby was also nominated for the Hart Trophy, which is the official league MVP. That award went to the Washington Capitals’ Alex Ovechkin.

Crosby wanted to win, but said losing out on the award will not cause him any lost sleep.

Crosby’s teammate, Kris Letang was nominated for the Norris Trophy as the league’s top defenseman. The award was given to Montreal’s P.K. Subban.

Maybe they sensed that there would still be a lot more hockey before the night was over.

Ten periods into their championship series, the Bruins and Chicago Blackhawks headed to Boston for Game 3 on Monday night. No one would be surprised if this one’s as close as the first two.

“I think it’s pretty much what everybody expected,” Bruins goalie Tuukka Rask said Sunday. “I mean, I don’t know if anybody expected to go to triple overtime the first game, but still it’s been tight, one-goal games. That’s usually how the playoffs go.”

Neither team skated on the off-day on Sunday, instead choosing to conserve their energy after playing four extra periods while trading overtime victories that left the series tied at one game.

“It’s a lot about getting your rest,” Blackhawks defenseman Duncan Keith said after arriving in Boston about an hour late because of air traffic. “It’s not rocket science, you just get sleep and do as best you can and do all those little things to get ready to go.”

After their triple overtime win in Game 1, the Blackhawks dominated the first period of Game 2, outshooting the Bruins 19-4. Heading off the ice for the first break, Tyler Seguin ditched the microphone he had been wearing as part of the TV broadcast.

Then he went back into the dressing room so the team could hash out its problems in peace.

“It was really a mix of everybody saying something,” Seguin said. “I definitely knew it was coming, so I threw my shoulder pads in the training room and put a towel over it so no one could hear what we were saying. I think we needed that team wake-up call.”

Only Rask prevented things from getting worse.

“Not much needed to be said after that first period,” said Chris Kelly, who was one of the more vocal players in the dressing room.

“I think Tuukka pointed out that was a pretty terrible period by our team. If it wasn’t for Tuukka, it would have been a lot worse.”

Neither Kelly nor coach Claude Julien nor any of the other Bruins would divulge what was said in the room.

But something snapped them out of their funk.

“Claude came in a little bit later, but I think we were all equally upset about that first period,” said Daniel Paille, who scored at 13:48 of overtime to end it.

“Definitely, Claude let us know and it was a way for us to wake up. And, also, players were keeping each other accountable, too, so it was good.”

Whatever was said, the Blackhawks managed only 15 shots over the next two-plus periods to Boston’s 24.

For the game, the Bruins had 50 hits — 10 by Milan Lucic — to 34 for Chicago.

“They’re in the Stanley Cup final for a reason,” Blackhawks forward Patrick Kane said. “It’s not like you’re going to have the momentum or dominate for three periods. Obviously, we’d love that.

“We know momentum is huge in the playoffs. You want to keep it as long as you can.”

But Blackhawks forward Dave Bolland said they relaxed after taking an early lead and dominating the first period. Another goal was disallowed when the referee lost sight of the puck and blew the whistle moments before it rolled under Rask and over the goal line.

“You always have to have your foot on the gas against this team,” Bolland said. “They’re a physical team. You see the guys they have. They’re a big team and they play hard and they’re going to hit, so you’ve got to be ready for that.”

Chicago coach Joel Quenneville said he didn’t think the team lost momentum by having an extra day off before Game 1 on Wednesday and Game 2 on Saturday.

“We had a great first period,” he said. “We did everything we wanted except get to two (goals).”

FAA spokesman Ian Gregor said Monday the Boeing 737 airplane landed without incident.

The redeye flight took off from Hawaii on Sunday night just before midnight and was scheduled to land in San Francisco on Monday morning.

Gregor said the FAA is working with United to determine the cause of the problem.

United Airlines spokeswoman Mary Clark said the flight was cancelled because of flight time restrictions on its flight attendants.

Clark said the plane is expected to return to service Monday afternoon.

Clark said the 93 passengers were accommodated on other airlines.

While it was mission accomplished in that sense, both of these teams know the series is a long way from being decided. The winner of tonight’s Game 3, though, will be in the driver’s seat with a 2-1 series lead.

For the Bruins to gain that lead, here are three keys to Game 3.

Milan Lucic, Wrecking Ball
In the days of Mark Recchi, the nickname “Wrecking Ball” was thrown around for the veteran’s willingness to skate to the dirty areas and take and give out the punishment that comes with the territory. But even Recchi himself never actually resembled a wrecking ball, at least not like Milan Lucic did in Game 2.

The big-bodied left winger used his size to his advantage in Game 2, absolutely bullying the Blackhawks with clean but heavy body checks all night long. On the stat sheet, Lucic was credited with a game-high 10 hits, four more than any other player, and though there’s no way to properly quantify their impact, there’s little doubt he helped wear down the Blackhawks. It was evident in the third period, when Lucic would enter the Chicago zone on the forecheck. By that point, Blackhawks D-men could be seen taking circuitous routes to the puck in order to let Lucic get there first. The D-men likely figured they’d have a better chance battling for the puck than they would getting crushed into the end boards.

The question for Game 3 is whether Lucic wore down himself with all that hitting. After more than 38 minutes on the ice in Game 1 and a punishing 24:33 time on ice in Game 2, Lucic is no doubt a little tired heading into Game 3. Then again, so is everyone else. If Lucic can once again impose his presence the way he did in Game 2, it’ll be another long night for the Blackhawks.

Tuukka Being Tuukka
At this point, there’s really not much left to say about Tuukka Rask. He saves just about every single puck he sees, and even some he doesn’t. His numbers are absurd, and he was the sole reason the Bruins had any chance to even win Game 2.

Fortunately for him, it would be hard to believe it could get much tougher than the first period of Game 2, when he stopped 18 of 19 shots, with only a Patrick Sharp shot through a couple of bodies finding its way into the net.

Unfortunately for Tuukka, the man across the ice has been just as good. Here’s how Corey Crawford’s numbers compare to Rask this postseason:

Crawford: 13-6 record, .935 save percentage, 1.72 goals-against average
Rask: 13-5 record, .944 save percentage, 1.73 goals-against average

For Rask, that means there’s no room for a letdown. While he didn’t really have much of a chance on three of Chicago’s four goals in Game 1, he may have to make an impossible save or two to keep similar shots out of the net going forward. Knowing how solid Crawford’s been for Chicago, it looks like these games will all come down to one goal. Rask is going to have to maintain his out-of-control pace as the team’s MVP for the Bruins to keep winning games.

A major part of the Bruins’ somewhat surprising run to the Cup Final was unlikely scoring from the blue line. Though Adam McQuaid made the play to keep the puck in the Chicago zone for the game-winning goal in Game 2, the defensemen have yet to find the back of the net for the Bruins this series.

Prior to the Final, the blue-liners chipped in with a healthy dose of complementary scoring. Johnny Boychuk netted five goals, which is still tied for fourth-most on the team this postseason. Torey Krug, quite memorably, scored four goals against the Rangers in the second round, while Adam McQuaid doubled his regular-season goal total with two, including the lone goal of the Bruins’ Game 4 win over the Pittsburgh Penguins.

In this series, goals from the D-men won’t be a necessity, but they may be the biggest key if the Bruins hope to try to build a lead bigger than one goal. Whether it’s a Boychuk blast through traffic, Krug on the power play or a well-placed wrister by Andrew Ference, Game 3 would be a good time for the D-men to get on the score sheet.

Leah Shahum, executive director of the San Francisco Bicycle Coalition, said the good news is that roads are getting safer, but adds that as more bicyclists take to the streets that means there is more that we can all do to know our rights and responsibilities.

SF’s Bicycle Coalition was founded in 1971 and is one of the largest in the nation with 12,000 members. Some of their recent accomplishments include the passage of workplace bicycle access legislation in San Francisco, the passage of Proposition B which provides funds for street work, and the expansion of the Sunday Streets closures as well as the pilot program for bikes on BART.

One of the more ambitious goals of the coalition as part of their five-year strategic plan includes getting half of the city’s population on a bicycle at least some of the time.

The bike coalition urban biking workshops are free and teach over 5,000 people a year. Shahum said they are available in Chinese languages, Spanish and even for seniors only.

Shahum has been a the helm of the coalition since 2002 and had previously served on the SF Municipal Transportation Agency’s board of directors as well as the Golden Gate Bridge Highway and Transportation District.

“You want to make sure you follow the rules of the road,” Shahum said. She explained that the most important thing is for everyone to “be predictable” when they’re out on the road. Whether you’re walking, biking or driving she said you should be signaling your actions.

“Whether you’re biking or driving, you have to give pedestrians the right-of-way,” she reminded. The bike coalition has a list of 9 Rules of the Road that they share in classes to anyone who wants to get acquainted with biker’s rights or even for drivers who may want to integrate more smoothly with those they share the road with.

One of those rules is, “Take the lane” it’s okay to get in front of a car. State law also says even if there is a designated bike lane that you can legally go into regular traffic lanes. There might be something obstructing the bike lane and a cyclist may need to abruptly pull out into a traffic lane.

“It is proven that the bike lanes make the street safer, which is great. For the driver it’s great because it can really help them where to be looking,” she said. “What we’re seeing in San Francisco and across the country when we create a more designated space that more people bicycle.”

Shahum explained that families, elderly riders, people new to bicycling and not as skilled riders become more comfortable and are more likely to ride and that the number of collisions goes down.

But with a city as densely populated as San Francisco and with vehicles, Muni buses and pedestrians is there enough room to designate any more bike space?

“There’s some give and take on our streets and there’s change.” But it’s not designated bike space on every street that the coalition is asking for. Shahum explained that what they need is a clear network of streets that connect to each other, obviously some work better than others in this area.

The big ‘if’, holding many back from getting on their bike, according to Shahum is having a safe place to ride.

When it comes to obeying the lights and road’s stop signs, Shahum said violators come in all shapes and sizes and are on all types of vehicles and that when a bike rider doesn’t comply with the law it’s more visible and it give the rest of the bicyclists a bad name.

Shahum noted that the monthly Critical Mass event where bicyclists take to the streets during rush hour on Friday is not affiliated with the SF Bicycle Coalition.

Right now the city is only spending less than half of one percent of its entire transportation capital budget on bicycling according to Shahum. “It’s a pretty dismal number,” she said. She said she hopes to see that number increase to 10 to 15 percent in the future. “We just want to make sure that the infrastructure is there so that people can ride when they want to.”

Lastly, Shahum said she thinks San Francisco’s pilot bike-share program isn’t going to be robust enough with only 700 bikes. She would like to see that figure at 3,000 bikes in San Francisco alone in order for the program to succeed.

The pipes backed up on the lower levels of the stadium during Oakland’s 10-2 victory, creating a stink and pools of water in the clubhouses used by both teams and the umpires.

The A’s and Mariners moved to a higher floor and cleaned up postgame in the locker room occupied by the Oakland Raiders during NFL games.

Coliseum officials said the six-day homestand, which drew 171,756 fans, overtaxed the plumbing system at the 47-year-old stadium.

“Make sure everybody finds out about this sewage thing,” Oakland starter A.J. Griffin said. “We need to get a new stadium.”

The San Francisco Chronicle reported that leaking pipes and backed up drains occur often, even on days when the Coliseum is empty. The field is 22 feet below sea level, and the clubhouse level is 3 feet below sea level.

A’s team president Michael Crowley told the Chronicle, “It’s clear, right? This isn’t the first time this has happened.”

Several Mariners left without showering. Towels were used to block sewage from running into the players’ general dressing area.

Seattle manager Eric Wedge’s office had about a foot of liquid, forcing him to hold his postgame news conference in the hallway.

The A’s, who start a road trip in Texas on Monday night, will likely have new carpeting when they return. The extent of the damage isn’t known yet.

There were visible wet spots around every drain on the ground floor, though the main damage was to the locker rooms and storage areas.

The site may be the worst transit stop in the Bay Area.

“It’s like breath of fresh urine every morning,” said Miley, a woman who commutes during the week. “Just getting off of BART and on the bus, I saw a guy get assaulted on the bus and these guys got off and then chased our bus.”

Three weeks ago, there was a triple-shooting nearby.

An online petition called “Clean Up The Plaza” has been set up to ask City Hall to do something it.

Going up the station’s escalator to the aboveground plaza, you can find a thriving market that is strictly underground. While spending some time there, I was able to purchase a USB plug cable for $2 and was offered some crack with a bonus “date with Margarita” in her room–for $5.

“We recognize that it’s got issues. Our stations at every location they’re at—every footprint that we have—are a microcosm of the surrounding area,” BART Deputy Police Chief Ben Farrow said.

“We are actually looking at some redeployment options and some ways of increasing the presence, or at least the perceived presence, of officers there,” said Farrow.

Farrow noted that patrolling the large Mission District means dealing with a lot of serious calls resulting in not enough officers to monitor the station plaza more often.

Miley said she can’t help notice the difference between Valencia Street just up a few blocks from the station with its trendy restaurants, cafes and posh shops.

“It’s depressing the way that Valencia Street is gentrifying, it’s like a really stark contrast between all the rich people moving into this neighborhood and then the people who need help,” she said.

ALL TIED UP: Many believed Boston and Chicago were the two best teams in the NHL this season, both possessing a lethal blend of potent offense and stingy defense. (Pipe down, Pittsburgh fans. The goal-a-palooza that was Sid the Kid and Co. was a sight to behold, but you have to at least fake some defense.) So it is fitting that the Bruins and Blackhawks head to Boston tied at one game each. The first two games haven’t always been pretty — ahem, Brandon Bolllig — but they have been fast, entertaining and, most important, evenly matched. Fans are definitely getting their money’s worth, and few can argue that the Kings or Penguins would make for a better matchup.

WORKING OVERTIME: Of course this game went to overtime. After Boston and Chicago needed OT to settle 10 games already in this postseason, including the 1-hour, 52-minute and 14-second marathon that was Game 1, there was no way this one was going to be settled nicely, neatly or in a timely fashion. At least this one didn’t turn into a night-day game, however, with Daniel Paille scoring 13:48 into the first overtime. No doubt there will be extended practices Sunday after such a short night. Boston is now 5-2 in overtime this postseason while Chicago is 4-2. Oh, and it’s not just the Bruins and Blackhawks logging extra hours. Game 2 was the 26th OT game of the postseason, tied for second most in NHL history. The record of 28 was set in 1993.

THE OLD MEN: Kids these days are such slackers. Jaromir Jagr has been playing longer than some of the Bruins have been alive. Really. That’s not an exaggeration. Yet there the old man was, leading Boston with five shots Saturday night, and coming close to ending the game a few times, including banging a puck off the crossbar in overtime. “I wanted to help the team. It was still a tied hockey game,” he said. “To score a goal would have been huge.” Jagr wasn’t the only one doing the senior set proud. Marian Hossa and Patrick Sharp, two of Chicago’s more veteran players, led the Blackhawks with seven shots each, and Sharp had Chicago’s only goal.

WHAT IF? Hossa’s disallowed goal isn’t the reason the Blackhawks lost Game 2, but it sure is fun to speculate. Shortly after Sharp gave Chicago the lead in the first period, Hossa appeared to double it. But the goal was waved off, with officials saying play should have been stopped because the referee had lost sight of the puck. Intermission came, the Bruins woke up, the Blackhawks dozed off and the rest is history. “It would have been nice to get it, but those guys make the call they see on the ice,” Sharp said. “As a team, we’ve been in situations where we’ve had some bad bounces and were forced to regroup quickly, so it didn’t affect us too much.” Had Chicago gotten that goal, however, who knows if Boston could have overcome a two-goal deficit?

HELLO AGAIN, CHRIS KELLY: Kelly’s tying goal in the second period was his first in the postseason since April 12, 2012, against Washington. Big deal, you might say, that was only last year. But the drought had dragged on for 23 games — or nearly the equivalent of the home schedule in this lockout-shortened season. “Just because he doesn’t see himself as a goal-scorer doesn’t mean he has to continue to have a goose egg on his stats,” Boston coach Claude Julien said. “Sometimes that stuff, whether you like it or not, will weigh on you. When you get a night like that, it certainly takes a lot of weight off your shoulders and creates some positive thinking and some positive energy moving forward.” The other positive is Boston’s record when Kelly scores in the postseason: a sparkling 10-1, including Saturday night’s victory.

The Blackhawks failed to clear the puck along the boards. Tyler Seguin picked it up and delivered a cross-ice pass to Paille, who beat Corey Crawford on his glove side for the winner at 13:48 of the extra period.

Game 3 is Monday at Boston.

It’s the second consecutive year that the first two games of the finals have gone to overtime, this one coming after the Blackhawks won a triple-OT thriller 4-3 in Game 1.

Crawford and Boston’s Tuukka Rask were outstanding in goal again after coming up big in the opener, turning away shot after shot in the extra period until Paille scored.

Jaromir Jagr just missed scoring the game-winner in the opening minutes of OT when his shot from the right circle hit the right post, his second near miss in as many games. Chris Kelly, who scored in the second period for Boston, had a shot from the slot stopped by Crawford at 5:39 of overtime.

Rask also stood his ground down the stretch, just as he did in the opening period, when Chicago simply fired away at him.

The Blackhawks swarmed the Bruins in the early going, taking the lead in the first on Patrick Sharp’s ninth goal of the postseason.

They continued to dictate the tempo until Kelly tied it with just over five minutes remaining in the second. Paille skated out from behind the net, beating Nick Leddy with a neat move for a wraparound shot. Crawford made the save, but Kelly crashed the net and knocked in the rebound to tie it at 1-all.

The Bruins nearly grabbed the lead with just over a minute remaining, after Paille picked off Duncan Keith’s pass and flipped the puck to a breaking Brad Marchand. He got pulled down by Brent Seabrook as his shot hit the inside of the right post, preserving the tie.

Either way, the Bruins had to like the way the period ended after being dominated most of the way.

They ended up outshooting Chicago 8-4 in the second after getting outgunned 19-4 in that area in the first, with the Blackhawks holding a 28-19 edge through regulation.

Rask had 33 saves while Crawford had 26.

The Bruins nearly took the lead early in the third when Jagr made a cross-ice pass to Marchand for a one-timer. Crawford came across the crease to block it with his body. Boston also had some chances in the closing minutes, with a shot by Jagr getting deflected over the net by Keith and Johnny Boychuk’s attempt from the blue line getting stopped by Crawford.

The Boston rally was in stark contrast to the early going, when the Blackhawks teed off and finally broke through with 8:38 left after Rask stopped a backhand and wrist shot by Patrick Kane.

The flurry continued with a slapshot by Michael Rozsival, and with the Bruins scrambling in the zone, Sharp wound up with the puck on the right side. He fired it past a screened Rask to give the Blackhawks the lead, with the Bruins’ Kaspars Daugavins and Andrew Ference jammed in front trying to cover Dave Bolland.

Chicago continued the siege against Rask, who had 18 saves in the period, but couldn’t add to the lead.

Then again, the Bruins couldn’t get anything going on offense. Sharp alone had more shots than them in the opening period with six, and things didn’t get much better for Boston in the second.

Crawford wasn’t really tested in the early going, other than a nice glove save on a high shot by Jagr midway through the first period and point-blank stop on Rich Peverley with 1:35 remaining. Star wing Nathan Horton was in the lineup for the Bruins after leaving the series opener with an injured left shoulder, a huge boost for a team trying to tie the series.

Horton got tangled up with Chicago’s Niklas Hjalmarsson in the first overtime, a pivotal moment for a key player to go down. But after watching Horton practice on Friday and skate on Saturday, coach Claude Julien declared him ready, saying he saw “absolutely no reason” not to play him.

For excitement alone, it would be hard to match what happened in Game 1, let alone top it.

From the late rally in regulation by the Blackhawks to the string of spectacular saves by Crawford to Jagr’s near-miss off the post and, finally, Andrew Shaw’s double-deflection goal to win it, that one was simply breathtaking. It added up to the fifth-longest Stanley Cup finals game in league history and a 1-0 series lead for Chicago.

Now the series is tied headed back to Boston.

The robbery was reported at 12:27 a.m. near New Montgomery and Natoma streets, where a 28-year-old woman and 38-year-old man had tried to park their vehicle, according to police.

A suspect approached and started an argument over the parking space, then hit the man several times and grabbed the woman’s purse before fleeing in a black SUV, police said.

The man complained of pain to his face but declined medical treatment.

The suspect, described as in his early to mid-20s, had not been found as of Monday morning, police said.

Speaking at a news conference outside the veterans memorial building near Lake Merritt in Oakland, Skinner, D-Berkeley, said the state Legislature last week passed a provision that would provide $3 million to send “strike teams” of 36 state workers to help shrink backlogs at U.S. Department of Veterans Affairs offices in Oakland and other locations in the state.

Lawmakers also passed a provision that would allocate an additional $3 million for county veterans service officers who would help veterans get their claims filed, she said.

“Our veterans put their lives on the line for us abroad, but here at home they are not being served and are facing a shameful situation,” Skinner said.

She said veterans coming home from the wars in Iraq and Afghanistan often have to wait from one to three years to have their requests processed for benefits such as disability claims, education expenses and employment services.

The problem is particularly bad in California, which has 2 million veterans—the most of any state, Skinner said.

The Oakland Veterans Affairs office, which serves all of Northern California, has the longest wait times in the nation, and the wait times have skyrocketed from an average of 283 days in January 2012 to 562 days now, she said.

Although the Department of Veterans Affairs is a federal agency, Skinner said California should spend money to help because “these people deserve it” and because the state’s effort could bring up to an estimated $886 million in federal funding to the state if all of the pending benefit claims are granted.

Skinner said Brown has until June 30 to sign the state budget but she’s concerned about reports that his aides have questioned why the state, rather than the federal government, should spend money to help reduce the backlog.

A spokesman for the governor’s office could not immediately be reached for comment.

(CBS SF/AP) – Dave Chappelle is making his most substantial return to stand-up comedy with a one-month tour for Funny Or Die. The comedian will headline the Oddball Comedy and Curiosity Festival, which kicks off Aug. 23 in Austin, Texas.

Along with a stop at the Shoreline Amphitheatre in Mountain View on Friday, September 20, the 13-date, two-stage tour concludes Sept. 22 in Phoenix.

The 39-year-old Chappelle has occasionally performed impromptu sets in comedy clubs. But he has largely avoided comedy and public life since abruptly leaving his hit Comedy Central series, “Chappelle’s Show,” in 2005.

Also on the bill are Flight of the Conchords, Hannibal Buress, Kristen Schaal and Al Madrigal.

Sen. Dianne Feinstein (D-Calif.) said the NSA will release on Monday a list of specific terrorist attacks foiled by its PRISM secret surveillance program. Last week, NSA Director Keith Alexander told a Senate panel that caution needed to be taken on what information is released.

Following last Friday’s disclosure by Facebook that it received up to 10,000 requests for user data during the second half of 2012, Apple said it received it received up to 5,000 requests. The companies however were not permitted to disclose which government agencies were requesting that data.

“I do think it’s important that we get this right and I want the American people to know we are trying to be transparent here, protect civil liberties and privacy but also the security of this country,” he said.

Christopher Swift, adjunct professor of national security at Georgetown University, said the public shouldn’t just focus the number of plots the PRISM program has thwarted.

“When Americans look at this issue, they should be looking at whether it’s legal, whether it’s effective and whether it’s wise. And if two of those questions are ‘yes’ ore if three of those questions are ‘yes,’ I think we are in safe space,” he said. “But if one of those questions is ‘no’ or two of those questions are ‘no,’ then we definitely have a need for national involvement and greater congressional oversight.”

Google, so far, has not released any information on raw data grabs by the government. According to the Wall Street Journal, the company questioned the value of such disclosures without the government to release more details on classified requests.

(CBS NEWS/AP) – Jay-Z is teaming up with Samsung to release his new album, unveiling a three-minute commercial during the NBA Finals on Sunday and announcing a deal that will give the music to 1 million users of Galaxy mobile phones.

The new album, called “Magna Carta Holy Grail,” will be free for the first 1 million android phone owners who download an app for the album. Those who do so will get “Magna” on July 4, three days before its official release, according to a Sunday statement.

In the commercial, Jay-Z is seen in a studio, working on the new material, alongside producers Rick Rubin, Pharrell Williams, Swizz Beatz and Timbaland. “Pretty much what the album is about is this duality, how do you navigate your way through this whole thing, through success, through failures, through all this, and remain yourself,” Jay-Z said.

Samsung is a leader in the mobile phone market and has been steadily chipping away at Apple’s share of the market with its Galaxy phones. The deal with Jay-Z is yet another example of how mobile companies are using music to lure new consumers.

Jay-Z’s wife, Beyonce, also has a new album coming out this summer. A release date has not been announced yet, but she’s been previewing some of the new songs in concert.

Jay-Z will be performing with Justin Timberlake on their “Legends of The Summer Tour” coming to Candlestick Park on Friday, July 26.

It’s not that the Heat hasn’t been in this situation before during the reign of the Big Three. In the trio’s first season with the Heat, Chris Bosh, Dwyane Wade and LeBron James came back from Texas in the NBA Finals trailing 3-2 to the Dallas Mavericks.

In the next game, Dallas put away the Heat and celebrated a championship victory in the AmericanAirlines Arena. Could history be repeating itself?

“We’re going to see if we’re a better team than we were our first year together,” James said.

In the first half of Game 6 of the series against Dallas in 2011, the Heat were blown off the court early in the game and never recovered. Now the Heat must recover after getting blown out twice by the San Antonio Spurs and put it altogether in Game 6 here in Miami.

“We challenge ourselves to see if we’re a better team than we were,” Wade said. “Same position no matter how we got to it.”

Unlike that Mavericks series, the Heat understand their roles perfectly now, but outside of the second half of Game 2 and the entirety of Game 4, the Heat haven’t been able to match San Antonio’s intensity or ball movement.

“We’re in a position where it’s a must-win and everything that we’ve done all year comes to this point, and we have to win,” Heat guard Ray Allen said. “We’ve found ourselves in so many situations this year, and we’ve thrived in tough moments because this is a tough team. We will be ready for Game 6.”

But don’t think for a second the Spurs are just going to roll over in Game 6, Miami knows if they are going to extend this series they have to take the game from the Spurs.

“I’m sure this team, they’ve been here before many times. They understand winning that last game is one of the hardest things you’re going to do. And we understand it as well,” Wade said. “But you know what? It’s the game; we’ve got to play it. I like our chances, just like they like their chances, in this series and in Game 6. We’ll see. We’ll see which team, which style is going to prevail.”

If Miami can win Game 6, the series will move to a final Game 7 on Thursday at the AmericanAirlines Arena.

Instead, the Spurs ran off another double-digit victory 114-104 over the Heat and took a 3-2 series lead needing only one victory to win another NBA Championship.

The first surprise of the night came when San Antonio Spurs head coach Gregg Popovich chose to insert guard Manu Ginobili into the starting lineup to match Miami’s small-ball lineup.

Ginobili started the scoring on a three-point shot that was in reality a two-point shot that the referees miscalled in real-time. The call would be reversed at the first timeout and changed to a two-point basket.

The Heat quickly countered with Dwyane Wade hitting a jumper and the two teams were off and running. both teams started off very aggressive, taking the ball right at the basket.

After trading baskets, the Heat opened up a seven point lead only to see LeBron James get a massive alley-oop dunk in transition that closed the lead down to just three points.

Ginobili hit a three-pointer to give the Spurs a six-point lead and Bosh responded with a quick layup off a Dwyane Wade pass.

By the time the first timeout was called by Popovich, the Spurs had a four-point lead and were hanging with Miami, despite the game going up and down the floor, which typically favors the Heat.

Both teams repeatedly got to the free throw line in the first quarter, but San Antonio struggled, shooting just 60 percent from the charity strip through the games first eight minutes.

As the quarter wound down under four minutes, Spurs point guard Tony Parker got rolling to the basket against Heat backup point guard Norris Cole. Parker hit two quick baskets forcing Heat head coach Erik Spoelstra to call a timeout with 3:46 to go in the quarter and San Antonio leading by four points.

But, just as quickly as Heat fans looked up, the Spurs ran off a 12-0 run to blow the game open near the end of the quarter.

The quarter ended with a Kawhi Leonard three-point shot for the Spurs and after one quarter, Game 5 looked very much like Game 3 of the Finals.

The Spurs’ Leonard, Duncan, and Ginobili all had seven points each in the quarter while the Heat were led by Wade and James who had 15 points between the two of them.

The second quarter got started much the same way the first quarter ended with the Spurs running past the Heat’s defense.

Miami was boosted by a quick three-pointer from Shane Battier, who has missed almost every shot he’s taken in the playoffs, but the Spurs responded just as quickly and the lead was back to 12 for San Antonio.

Miami had to call a timeout after just three minutes of the quarter after Chris Bosh got an offensive rebound and when he got to the huddle, Bosh was screaming at teammates to move the ball.

The blowout seemed to be on as the Heat couldn’t hit any shot in the first half and Danny Green continued to hit three-point shot after three-point shot, most of them completely uncovered.

Coach Spoelstra decided a little more than half-way through the second quarter that it was time to bench both Norris Cole and Mario Chalmers who were both completely ineffective in the first half.

As the first half continued to wind down, the Spurs were hustling off screens and continually outhustled the Heat to every spot on the court.

But as soon as the point guards left the floor for the Heat, Wade, James, and Bosh helped run off a 10-5 spurt over San Antonio to close the lead to just 11 points with 5:45 left in the half.

Miami continued to pour it on with a four-point play from Ray Allen who hit a three-point shot while being fouled and the Heat closed the lead to 5 with a 12-0 run before Duncan hit a falling-down jump shot to push the lead back to seven points.

As time wound down in the first half, Bosh had to go to the bench after picking up his second foul with about 3 minutes to go. Bosh single-handedly kept the Heat in the game in the first half and no one played defense on Duncan better than Bosh in the first half.

The Spurs ended the first half with a quick basket by Parker and finished with a 61-52 lead over the Heat.

San Antonio had four players in double-figures led by Duncan and Green who had 13 points apiece. Miami was led by the Big Three again with James at 16, Bosh at 10, and Wade at 14.

San Antonio shot the ball at a 62 percent clip from the field in the first half compared to Miami’s difficulties at 42 percent from the floor.

Miami started the scoring in the second half with a LeBron jumper followed up by two straight turnovers by the Spurs. Mario Chalmers hit a key three-pointer and narrowed the lead to four before LeBron went to the basket on a fast break and was fouled by Ginobli.

James made two free throws and the Heat were on a 7-0 run to start the third quarter before Parker responded with a quick bucket off the glass and the lead went back to four with just under 10 minutes to go in the third quarter.

But just like the case has been with each game in the series, the Spurs turned to Danny Green who hit a three-pointer to extend the lead back to seven points with nine minutes to go in the quarter.

Green’s first three-pointer in the third quarter broke the record for most three-point baskets made in a NBA Finals. The record had been held by the Heat’s Ray Allen.

The team’s continued going back and forth with Chalmers hitting another three point shot to close the lead to five points withe 7:11 to go in the third quarter.

The Spurs’ Danny Green then stopped two straight fastbreak opportunities with Wade and James running the break for Miami.

And just as quickly as the Heat closed the lead the Spurs ran right past a completely gassed Heat team to extend the lead again with four minutes to go in the third quarter.

The problem with the Heat was no matter how many times the Heat closed the lead to 3-5 points, the Spurs responded, usually with a Danny Green three-pointer to drive a dagger into the hearts of Heat fans everywhere.

The Spurs exploited the lineup of the Heat with Shane Battier, Allen, Cole, and Udonis Haslem on the court and ran off a quick 10-0 run to push the lead to 11 with less than a minute to go in the quarter.

San Antonio’s run to close out the third quarter was the difference in the game with the Spurs leading Game 5 87-75 heading into the fourth quarter.

As the fourth quarter got rolling, Ginobili continued to hammer the Spurs and Miami had no one able to protect the rim whenever any San Antonio player got into the lane.

The lead was extended to 17 points on a Kawhi Leonard three-point shot and Miami looked ready to run out of the AT&T Center with its tail squarely between its legs in the 2013 NBA Finals.

LeBron was again struggling from the field despite having 22 points in the game. San Antonio built the 17 point lead with a 19-1 run at the end of the third quarter and into the fourth quarter.

By the time Spoelstra called a timeout, San Antonio was up 94-75 and the game looked out of reach.

All five of the Spurs’ starters were in double-figures with 10 minutes to go in the game, led by Ginobili’s 22 points in his first start of the season.

But Miami wouldn’t just quit and two three-pointers by Ray Allen and a dunk by Bosh pulled the lead down to 13 points with just less than seven-and-a-half minutes to go in the game.

And then Ginobili and Duncan continued to break the heart of Heat fans everywhere by continuing to hit shot after shot in Game 5 and just as quickly, the lead was 17 points again with five minutes to go in the game.

The Heat kept coming and closed the lead to eleven points with 3 minutes to go in the game after Ray Allen stole the ball and hit a three-point shot from the corner.

The Heat finally closed the lead under 10 points with just under two minutes to go in the game with a layup from Allen. Wade came back the next time down the court and missed one of two free throws and San Antonio led by 8 points.

But, just like every other time the Heat closed it to single digits, the Spurs got a quick two-pointer from Parker and then another three-pointer from Green and the lead went back to 13 points.

At that point, both teams emptied the bench and the game was over except for the final score.

The Spurs finished off the game with a double-digit win 114-104 and the Spurs head to Miami up 3-2 in the NBA Finals with a chance to close out Miami in Game 6.

Parker, Green, Ginobili finished with 26, 24, and 26 points respectively for the Spurs while Miami was led by Wade and James who finished with 50 points total.

Game 6 will be at the AmericanAirlines Arena on Tuesday night.

The taxi driver had taken a 37-year-old man to the area of Waller Street and Central Avenue around 1 a.m. Sunday and the victim asked for his change back, leaving no tip for the cabbie, police said.

An argument ensued and the passenger tried to flee but the driver caught up to him and began choking him, police spokesman Sgt. Dennis Toomer said.

The driver then got back into the cab and drove off, Toomer said.

The victim described the taxi driver as a white, balding man between 30 and 40 years old who has a muscular build and was wearing a polo shirt and jeans, Toomer said.

The victim did not know what company the driver works for, but said the taxi was white with red lettering, according to Toomer.

He was taken to a hospital to be treated for neck pain, Toomer said.
