OAKLAND (CBS SF) — A police officer shot a male suspect in Oakland Friday night after he allegedly attacked officers when they attempted to detain him for urinating in public, police said.

Officers attempted to detain the man, an Oakland resident, for public urination in the 2100 block of Fruitvale Avenue at around 7:40 p.m.

Police said the man became violent, assaulted an officer, and attacked the officers with a long, metal blunt object.

An officer pulled out her firearm and shot the suspect to defend the officers, according to police.

The suspect was taken to Alameda County Medical Center for his injuries and was expected to survive.

An officer was also injured during the incident. She was taken to Summit Hospital and was treated and released.

Anyone with information regarding this incident is asked to call the department’s homicide section at (510) 238-3821.

The subject was shot because he assaulted an officer. The “public urination” is part of the story but does not deserve a place in the headlines.

    1. Scottie Dont says:

Sure it does…it’s sensational. If they could have, they would have said “Suspected Tea Party Terrorist Gunned Down During Racially-Charged Attack on Defenseless Female Cop After Being Stopped for Indecent Acts In Dark Alley, Obama, Reid and Pelosi Have No Comment”

…but that has too many words.

I think there will be a riot; all public urinators will be incensed by this police “brutality”.

Ha! YOU got that right. Maybe the headline should read: “Homeless PTSD Vet Percieving Personal Attack Was Murdered by Policeman After Scaring Him to Near Death By Grabbing his Arms After He Urinated in the Street R/T Too Drunk to Walk to Bathroom 6 Blocks Away” For Pete’s Sake! Killing a man for peeing in the street? You march up to me, grab me by the arms, and yank on me, and I’d try to fight you off, too, idiots. I have spine disorders, and to grab me is to torture me. Those cops were out of line. I bet at least half those jerks have peed in a non-toilet place before. A talking-to would have been enough, and a fine, not grabbing him! Police Brutality.

YOU sound like an blooming idiot!!!! You soun like a animal raised in a cave. Yes, just allow these “low-lifes” to urinate and defecate on the streets … guess you like to trample through feces and urine – then go back to the filthy cave you came out of!!!!!!

Wrong, it does belong in the account. It was what led up to the assault. There was another important item that should have appeared in the report but didn’t.

    3. Rick says:

Should we be surprised that this defiant one resisted arrest? Not!

      1. eddie too says:

this may be quite sexist, but women cops are always going to have to resort to guns before male cops due to their inherent physical weakness.

women cops by nature are going to fear arrestees more than male cops.

awesome. In the st louis newspaper, a few months back a headline said “Boy shot by store owner shoplifting potato chips” you actually had to read the article to see the kid pulled a gun.

Is kidnapping appropriate for urinating ? How about death for resisting being assaulted ?..

      1. bob says:

        Yes to both

      2. John Carpetta says:

Resisting arrest can get you killed. The police have the authority to arrest people committing crimes, even ones you personally don’t care about.

    6. Ron Reale says:

He did not just “assault a policeman” out of the blue. His actions are part of the Headline. (Drunk driver resists arrest, rapist resists arrest… the criminality is ALWAYS in the headline!

      Ron Reale

    7. Stephen says:

Subject was shot because the officers were women and had to resort to shooting in what was otherwise (if male officerrs) a routine matter.

    8. Tuco says:

Agree completely with ‘Arch Stanton’. A suspect resisting arrest and attacking an officer is no less dangerous…whether he’s being arrested for public urination or murder.

  3. tn says:

Just remember this-… the suspect shot first….

    1. granny says:

Where did you get THAT from???

    2. John Carpetta says:

Correction: the man became violent, assaulted an officer, and attacked the officers with a long, metal blunt object.
Same dif, really. He attacked, got killed. Long, metal blunt objects can kill, even if they aren’t as sexy as guns.

  4. Bubba says:

I think burris should sue the city for not having enough public restrooms made available for the winos and 40 oz crowd.

  5. Sigmund says:

Glad the Officer had the where-with-all to shoot. We might have been reading headlines about an OPD death this morning if she had not. People attacking small stature Officers need to realize, they’re shootable. If I was an Officer that weighed 110 dripping wet and a 250 pound body builder attacked me, use of my handgun is JUSTIFIED!!! Just too bad the attacker was not killed by lead poisoning.

    1. PCamerica says:

This is what happens with the pussification of the police forces to be PC.

    2. marty says:

Small folk should not be members of a profession where violence is inevitable. Just like large people should not be jockeys.

    3. sjlintampa says:

This whole business that cops somehow have a right to summarily execute citizens is a bunch of @(##*. If the prep had a gun or was cutting people with a knife, then maybe use lethal force, if non-lethal means are not effective. This country is turning tnto a police state

      1. HM Phobe says:

If they are attacking the cop – yes, the cop has the right to “summarily execute”

      2. Chris says:

Are you kidding?! The article says the perp was armen with a “long, blunt metal object”! Does that not constitute a leathal weapon to you? If someone had attacked you with it they’d be charged with assault with a deadly weapon! If this dirtbag went after the two officers with it then he’s lucky to be alive. There was also one officer injured in the incident, so I fail to see your problem with this.

      3. sjlintampa says:

Maybe the guy thought that the arrest was unlawful…..

Citizens may resist unlawful arrest to the point of taking an arresting officer’s life if necessary.” Plummer v. State, 136 Ind. 306. This premise was upheld by the Supreme Court of the United States in the case: John Bad Elk v. U.S., 177 U.S. 529. The Court stated: “Where the officer is killed in the course of the disorder which naturally accompanies an attempted arrest that is resisted, the law looks with very different eyes upon the transaction, when the officer had the right to make the arrest, from what it does if the officer had no right. What may be murder in the first case might be nothing more than manslaughter in the other, or the facts might show that no offense had been committed.”

      4. bob says:

Glad you think that “long blunt metal object” was not something that could bash your head in with, or do a job on your face, so if your coming at me with anything that could harm me, and I had a gun, you bet your sweet axx I’d empty the whole chamber in your direction.

      5. sjlintampa says:

bob@ maybe instead of trying to kill the guy…I’ll pull out my tazer or pepper spray and attempt to incapacitate the dude before I try to kill him.

      6. Jim M says:

I agree. We need big Irish cops to beat people like the perp to a pulp with big mahogany nightsticks.

    4. Marbran says:

Is the use of a handgun justified only when it’s a cop under attack? Every law abiding citizen should be allowed concealed carry for just this reason.

      1. Regulas says:

      2. bob says:

That’s why I live in Arizona, where concealed carry is legal. Assault me, my wife or kids and you’ll only have one chance to do it, after that one try, you’ll never get a second chance.

    5. BlueStarFlag says:

If an “officer” weighs just 110 llbs dripping wet then she should be waiting tables or a Dr’s or lawyer’s receptionist. She has no business riding around in a squad car trying to prove she’s as tough as a man.

Anyway, urine is a great fertilizer, and it is much greener to pee in the yard, than to use clean water to send it to the sewage treatment plant, where it will cause eutrophication of the waterways. Why do the cops care? I’ve been to Oakland, and I’m sure they haven’t run out of felonies.

    1. max ventura says:

Peace officers? Yea right. You must stay at home alot a watch tv. Police threaten people for the simplest of things. I had police friend that use to brag if an arrestee gave them lip they would not restrain the handcuffed arrestee in the backseat during transport. Then he said “we would get up to 50 or 60mph and slam on the brakes”.

      1. Dad says:

That’s a very common cop trick, as is the smash to the genitals while conducting the pat-down. They usually do it behind the desk, where the camera can’t actually catch the action.

    2. Marbran says:

Peace officers? Do not call them that. They are ‘law enforcement’ officers. They are there to apprehend anyone breaking any of the thousands of laws that are on the books. They could care less about any ‘peace.’ Besides, if there were more peace, they’d be out of a job.

  20. JohnnyFreedom says:

I love how the headline is written to speak against the police. (typical San Fran-Sicko liberal spin) He attacked and tried to harm and possibly kill police officers. The fact that he was peeing before holds no relevance. The perp got what he deserved (world would be better off if it killed him) and cops did what they had to do.
    Good job officers!

Thank heavens there are no police on a golf course. 🙂

    1. Jim M says:

Why? Most golfers don’t assault cops. That’s the issue. The perp turned a minor incident into a felony and got what he had coming.

      1. BlueStarFlag says:

So what, they’re not trained to use those batons anymore? Battery was dead on her taser? Hell, they got tougher R.O.E. in Afghanistan and Iraq.

    2. Chris says:

Oh blow it outta your kazoo Tony! If the asshat that got shot had simply zipped up he’d probably have been given a citaion at most. Instean this genius decides to attack two armned police officers with a “long, blunt metal object”! So let me ask you Tony; how would you like it if he’d have assaulted you instead, hmm?

  29. bustathug says:

    1. Ed Cole says:

Only in SF would someone pick a screen name that rhymes with Felcher.
(but I agree with your comment)

  34. Gene says:

To bad the guy made it

  35. Peeing in the Alley says:

So he “allegedly attacked”, but then assaulted police officers. Which is it…he either did or did not assault the police. The guy was doing something illegal, doesn’t matter what it was but he chose to be combatant and got what he deserved, end of story. Cops did a fine job and should not receive any doubt or scrutiny of this case.

    1. Say No to SS Thugs says:

Yes, and they originally claimed that Oscar grant was going to assault the police as well. Are you going to be stupid and continue to believe their lies?

  36. AlphaTaco says:

  38. flashman1854 says:

I hear there are some kids, recent law school grads, who are suing their old law school because they can’t find work. (This is a current news story out of New York).

Well, kids, here is your lucky day! If you’ve passed the CA bar (and are qualified to practice in CA, or can work out a relationship with a CA attorney) you may have just found some real work. SUE the Oakland PD for shooting this poor, unarmed, gentle, “just minding his own business”, victim. (It’s too bad for the Oakland PD that the guy didn’t die.)

Yes, its another opportunity to make a lawyer rich.

By the way, at the end of the article they ask the public to contact the Oakland PD homicide section. Why? The guy is not dead, and even if he was, it’s not homicide. I think a better request is for anyone with information to contact a lawyer. As I say, here is a good opportunity for a Shyster to make quick buck.

  39. Augie Dogie says:

yeah right….its time for the formation of neighborhoood militia to deal with police. Army of the New Republic needs people, we don’t take applications only committments….form a jeffersonian sleeper cell in your city to organize anti-tyrany marches and actions against those that try to enforce laws but don’t try to maintain the peace.

BS…………just like they didn’t slam a guy to the ground, handcuff him then shoot him in the back and say he was armed so they had a right to murder him………………

  43. Roger Finkelstein says:

Check out the deceiving headline that CBS puts on the story. The male was shot for ASSAULTING A POLICE OFFICER WITH A LONG METAL BLUNT OBJECT- not for taking a leak. I wonder how many times the reporter would have to be hit with a blunt metal object before he wished HE or SHE had a gun.

  44. Gas_Passer says:

It’s good that some bum gets shot for taking a leak in public. Give the officer a promoting!

  45. Aged Cheddar says:

So the crime of battery on a police officer now justifies the use of deadly force?

Is it not true that had the officers involved been physically capable of dealing with this criminal, deadly force would not have been necessary? Don’t police officers get night stick training anymore?

It’s disturbing to know that if an officer feels she cannot subdue you by other means, she will just bust a cap on your sorry butt! Let those jay walkers know who’s boss.

    1. Joe D says:

Yeah, it would be much better if the policewoman would just let a guy beat her to death since shooting him would be too mean. Your chances of being shot by a cop go way down when you do not resist and do not assault them. Completely justified shooting here.

    2. david says:

Actuallly yes, I was a Deputy Sheriff for five years, if a suspected is about to overpwer you, we were taught to stop them by any means ie shoot them. If a suspect over powers a cop they can take the cops guns and kill the cop and anyone else they would like to.

    3. Jim M says:

Whatever made you think a person can assault a police officer and get treated with kid gloves? That type of thinking gets idiots killed all the time. I personally would rather see the guy get beaten to a pulp, but it’s not a perfect world. It’s the police’s job to protect the public, not the criminal. If you disagree with the cops tell it to the judge.

Sarah August 27, 2011 Where did you stay in Costa Rica? It looks beautiful. Andrew and I did an all-inclusive for our yhenomoon too and it was great. We stayed at Couples in Negril, Jamaica. We loved Jamaican food! Callaloo and jamaican patties and jerk chicken and curried goat and ackee and breadfruit it was all wonderful. We had lobster a couple of times at the resort, but the best lobster we had was when we wandered away down the beach and found these crazy old Jamaican fisherman cooking over a fire on the beach. They served lobster (caught just before cooking) with fresh lime and scotch bonnet peppers. It was amazing. They called it the Office of Nature and I don’t know why, but it worked!

    1. Jim M says:

The drunk didn’t assault any police officers, though, did he? I can’t believe you morons can’t see the distinction.

  49. Nextset says:

Officers are being hired as light as 125 pounds. This is being done for affirmative action reasons. Women must be hired and once you reduce the minimum weight requirement for women you can’t keep it higher for the men either. When the thugs attack these small police officers they must be quickly killed. So thugs should stop attacking armed small people especially cops. Sam Colt made them equal. Think of this as evolution in action – and the consequences of diversity in police work.

  50. WackedOutWorld says:

Let me get this straight shoot a man for answering mother natures calling but let mobs of hoodlums run around beating & stealing people.

  51. Brenda says:

So many police officers are trained by the military so naturally they view law breakers as the enemy. They are taught to treat resistance with maximum measures. Ex-military should either receive enhanced intensive training to deal with civilian populations or be barred from police service.

  52. PC police Fail says:

Perhaps if they hadn’t had to hire their qouta of women.. and where able to have physical standards – they could have restrained him instead of killing him for peeing.

LOL this thread is too funny. It lies “dead” for two days then all of the sudden it comes alive this morning…What changed?

Then at about 9:30 this morning they change the headlines from: “Oakland Officer Shoots Suspect In Alleged Assault And Public Urination.” To “Oakland Officer Shoots Public Urination Suspect After Scuffle.” And then they changed the order of the replies…

  55. aubreyfarmer says:

The police are the enemy because they have completely sold out their humanity and respect for others for the almighty dollar. There is nothing they won’t do for a paycheck. Will it get to the point that when a policeman pulls you over that there will be those that come out shooting? When the cops start being afraid of us once again, then we will get some respect. You can bet this is all about the cops over reacting. What a bunch of blood thirsty, trigger happy fascists the police have become. Why are the good cops not speaking out against the bad cops? The cops are never there when you need them and when they do show up they are just as likely to kill the wrong person.

    1. Darwin says:

Wow, are you a grade A moron! If you really feel this way, you need to move to another country. I hear Mexico is quite nice and the cops there do not do anything, they are all too busy trying to deal with the Cartels or being paid by them.

Yeah kill him. Shoot him in the face! Don’t let him get away with peeing!

He may have been resisting arrest, but he was resisting arrest for peeing. Shooting someone for this? A bit much.

Ever occur to supercop to maybe let him go instead of endangering everyone else’s life by shooting off her firearm in a crowded public place over someone going to the bathroom where they’re not supposed to? How about a little common sense? Sounds to me like the guy was greatly outnumbered. No one thought of a taser? How bout just some old fashioned clubbing? You shot him to protect the OTHER OFFICERS THAT WERE THERE??? Why did you have to shoot him? You outnumbered him. Sounds like a retro-excuse to me.

  58. irjeenyus says:

He peed and he was rude to the cops. Kill him.

  59. buckeyejim says:

Tough luck crook, don’t attack police……….she should have shot you in the groin.

  60. Say No to SS thugs says:

If you have information call the homicide department? I am not going to get my hopes up that this officer will get His due and be tried for MURDER.

  61. malcom says:

wouldn’t you think just giving the person a ticket would have been so much easier? I mean , hell, men blow each other and pass AIDS in public and people snoke pot in public I dont see cops bothering them or trying murder them.

    1. bob says:

But are they ASSAULTING cops when they are doing those things?

  62. JustAGuy says:

Isn’t Oakland next to Berkeley? I predict the Berkeley city council to put forward legislation to confirm the right to urinate in public.

  63. Dan says:

Sounds like a text book Good Shooting, only problem is the suspect lived !

  64. paul92107 says:

  65. mark says:

Guns are dangerous in the hands of the government. Look people, when approached by a cop, bow down, lick their boots for the asskicking and false charges you are about to receive. Police will kill and lie ALL the time, so welcome to the USSA.

  66. Hank Warren says:

Out of control cops shooting everyone when they are not writing speeding tix, yet another violation of our rights. Add it to the list of gov’t violations of our rights:
They violate the 1st Amendment by placing protesters in cages, banning books like “America Deceived II” and censoring the internet.
They violate the 2nd Amendment by confiscating guns.
They violate the 4th and 5th Amendment by molesting airline passengers.
They violate the entire Constitution by starting undeclared wars for foreign countries.
Impeach Obama, vote for Ron Paul.

“To protect and to serve”… my ass!
There was probably no “blunt object,” either.
It’s no wonder people HATE cops… they lie and get away with murder. It makes me wanna vomit.

    1. Dan says:

I don’t hate em and I think this mutt got what he asked for. Hope he gets 20 in the big house

  69. Brainwashed American says:

No doubt, the “Gentleman” peeing was either a Judge or a Doctor. I’ve this much from watching TV!

  70. Archie Bunker says:

LOL… SF gets what it deserves. I heard that public urinating is so widespread that the sidewalks are cleaned every morning with bleech.

  71. Ylem says:

SF used to be a nice city but now, thanks to Liberal insanity, there’s an increase in illegal alien crimes and the homeless population — all are the very people who urinate in the streets.

  72. Finley says:

You idiots blame the cops but what I’ve found is that people who criticize the cops never treat the police with respect. The SF cops have to deal with an increase in illegal aliens and the homeless population, and the crime that those bring due to you Liberals in SF and all of California.

You have no one to blame but yourselves.

  73. bob says:

    To bumpkin,
You stated this person was killed by the police, but the article indicated he was taken to the hospital where ihe is beening treated and should servive.

  74. luke shumway says:

i live in new mexico and here the cops will gun you down like a manjy dog if you have a spoon in your hand or a cell phone “for officers safte” and they get off scott free.”it was a justifyed shoot the officer followed all policies, if the officers are so scared of us maybe they should work at a fast food joint.

  76. tom says:

Oh! San Francisco is not strange with me at all. It is even worse in many ways

  77. James Woods says:

I don’t buy the assault claims when the cops are the ones that approach someone. Perhaps the guy had a record or just committed another crime and was on edge.

I think the key word in this article is it was a female cop which regardless of how you want to look at it unless she was a 6.5 tall 300 lb woman I doubt anyone is going to be afraid of these “cops” and you’ll find them shooting people because they lack the ability to physically subdue them.

We’ve all see the police chases where the department lets the female officer cuff and stuff the perp on camera because it makes them look diverse and you’ll see the officer struggling and requiring the help of male officers.

Enough with the “diversity” or the next time your taking a wee you might end up dead in san fran.

  78. Ing says:

It was not necessary right at that moment to try to physically remove the man if he was in an agitated state of mind. They should have talked to him calmly, gotten some backup, made sure he was not exposed and not hurting anyone, evaluated his mental state. Sucks but that is the job, not shooting people for peeing. There are a lot of mentally ill in those streets – either scoop them all up in vans and get them treatment (the cops know where they tend to roam) or be prepared for dozens of pointless confrontations like this a day.

  79. Anarchy is not choas says:

Oakland cops kill again! This is getting out of hand…

    1. Dan says:

Sure is, I wish this criminals would just do the right thing. It’s is them who make the choice.

    2. Klaus says:

Police should be disarmed across America.

Remember when England had Bobbies, before they became a police state?

How many billions of dollars in drug money were laundered in Oakland banks while the cops were busy shooting this human being?

  80. lsj says:

    1. Kawashima says:

I did read the article my point was not that Henry Ford was the only one or the first one, or even one among many, my point was that he was the most feocrful one. He didn’t just establish the 8-hour work day, he did it by also raising wages and reducing the work week to 5 days, instead of the more common 6.The even more important point in this exchange though is that he did this for purely profit reasons, in other words, yes the wind was blowing , but it was only blowing because of competition (else he wouldn’t have been able to do it profitably, or done it at all), not because of the wannabe moral crusaders’. Go back and read your article and you will notice that the countries that established the 8-hour work week tended to also be the richest countries of the world at the time, mostly because of a market economy (and/or because of imperialism). In other words, it is through competition and markets that you can reach the level where an 8-hour work week can be accomplished with minimal (or atleast not detrimental) consequences (else underdeveloped countries could wipe out poverty just by enforcing U.S. labor laws). However, history has shown what an economy would look like without markets and a regulated intensive government just look at communism.Henry Ford showed the world that establishing the 8-hour work day, shortening the work week to 5 days, and doing it by raising wages is profitable. Competition has pushed many others to do similar things, whether it is less labor intensive jobs, greater benefits, or higher real wages (less than 2% of the populations makes the minimum wage, for example), these advances have been in spite of moral crusaders’ not because of them (see more ), yet the economically ignorant, especially those in the Chicano Studies community, like to think the opposite. But keep thinking whatever you want!’

  85. Whizzer says:

When I got caught urinating in public, they did not shoot me. I said,”Hey, I was just shaking hands with the Governor!” We all laughed and then they gave me a ticket.

  86. SomewhereinFL says:

Police have to learn you shot to kill. It would have been one less Obama voter. Obama voters, shrinking every day, mostly with jail sentencing, the rest are just wising up.

  87. jnsesq says:

You resist arrest, you take your chances. I have no sympathy for this feral and those others to whom you San Franner types seem content to relinquish your streets in the name of “diversity and multiculturalism.” May it next time be on your leg.

  89. Chris says:

Wow, what horrible reporting. This just stinks of anti-cop bias. The guy could have been picking his nose when the cops walked up to him, but it doesn’t matter, he came at them was a weapon. What should they have done? Run? Use verbal judo? Offer him a candy bar? Perhaps shot the weapon out of his hand? Such irresponsible journalism is offensive.

    1. Adam Merz says:

you’re an idiot that watches too many movies

  90. B.O. says:

I don’t know any details of the case, but I believe that the Oakland Police acted stupidly.

  91. Tuvak says:

  92. frank says:

    Illegal Arrest: KNOW YOUR RIGHTS

ìAn illegal arrest is an assault and battery. The person so attempted to be restrained of his liberty has the same right to use force in defending himself as he would in repelling any other assault and battery.î (State v. Robinson, 145 ME. 77, 72 ATL. 260).

You donít have to run when resisting an illegal arrest:

ìWhen a person, being without fault, is in a place where he has a right
to be, is violently assaulted, he may, without retreating, repel by
force, and if, in the reasonable exercise of his right of self defense,
    his assailant is killed, he is justified.î (Runyan v. State, 57 Ind. 80;
    Miller v. State, 74 Ind. 1).

If you see someone being arrested illegally, you have the right to:

ìOne may come to the aid of another being unlawfully arrested, just as he may where one is being assaulted, molested, raped or kidnapped. Thus it is not an offense to liberate one from the unlawful custody of an officer, even though he may have submitted to such custody, without resistance.î (Adams v. State, 121 Ga. 16, 48 S.E. 910).

    Up to the point of:

ìCitizens may resist unlawful arrest to the point of taking an arresting officerís life if necessary.î Plummer v. State, 136 Ind. 306. This premise was upheld by the Supreme Court of the United States in the case: John Bad Elk v. U.S., 177 U.S. 529.

  96. Rick H says:

This sounds like a result of female affirmative action.
The article says the shooter and another police officer were females.
In the old days, male police officers would of handled this without killing the guy.

  97. Klaus says:

How come the cops never shoot the politicians when they urinate all over us?

  101. Laura Lemieux says:

What happened to Mace? You have a crude guy resisting arrest with a non-deadly weapon in light of the fact that he was outnumbered.

I’m NO liberal, but I don’t want to condone a society that accepts this kind of behavior. I mean, a large percentage of people who urinate in public are likely to be “off” mentally. Approach with caution. Use good judgment. Don’t go breaking out guns when Mace might work or even a good punch to the face.

    Ron Paul rules.

  103. Guest says:

The officer was shot because the cop was a female who wasn’t able to adequately defend herself and had no business being anything but a “desk” cop. Due to political correctness she was given the job of “policewoman” and a large gun for just such instances.
I can hear her now… wow, that was fun… bring on the next big guy.Guest

  104. Oldclimber says:

The pee-er had the misfortune of being handled by women police, who are more viscous, and trigger prone when ANY threat, real, imagined or pumped up after the fact, presents itself. That is given they haven’t avoided the confrontation altogether. Too bad, pee in your pants next time bunky.

  107. JaneQPublic says:

In the interests of letting the ‘punishment’ fit the crime, the officers could (should) have just aimed a taser on the ‘stream’ and walked away. Result? Instant operant condtioning – he would never have urinated in public again! LOL!!

Oh – and he wouldn’t have been in any ‘position’ to weild a pipe for a while either…
