SANTA CLARA (CBS SF) — Prosecutors say two 49er fans accused in a brutal attack in a Levi’s Stadium bathroom last Sunday were provoked by a simple tap on the shoulder. Meanwhile, injuries to one of the two victims are more serious than previously believed.

27-year-old Amador Rebollero and his 34-year-old brother Dario Rebollero were arraigned Wednesday afternoon on felony assault charges.

Santa Clara County Deputy District Attorney Deborah Hernandez said the attack occurred when one of the two victims – who are cousins – tapped Amador Rebollero on the shoulder to inform him that an open bathroom stall was available as they waited in line.

“These victims were just standing in line at the bathroom, waiting their turn, trying to make the line move, and then all of a sudden they are beaten,” she said.

Hernandez spoke outside the Santa Clara County Superior Court room in San Jose and said the attack on the two unidentified victims was vicious and unprovoked.

“These victims were beaten like animals,” said Hernandez. “One of the victims has suffered severe injuries. He has some bleeding to the brain. He has had to have partial skull removal to relieve some of that pressure. He is currently suffering some paralysis.”

Amador Rebollero is being held on $350,000 bail. Prosecutors say he is the main assailant in the attack. Dario Rebollero is being held on $75,000 bail.

Video of the attack inside the Levi’s Stadium restroom was posted on YouTube.

Both the suspects were silent and showed no emotion in court Wednesday.

Plea entries in this case are scheduled for October 30th.
