BERKELEY (KPIX 5) — California could have to hand over some documents on cellphone use it tried to keep under wraps.

On Friday, a Superior Court judge said the state must release papers discussing the possible risks of long-term cellphone use.

UPDATE 3/13/17: The judge issued her final ruling. The “document advising the public of the risks of Electromagnetic Frequencies (EMF) associated with Cellular Phones” is a public record and must be turned over to the public.

Following the tentative ruling in February, the state released a redacted copy of the document. This ruling orders the state to release an un-altered version in its original form.

The documents were written by the state’s Environmental Health Investigations branch and are believed to contain cellphone radiation warnings and recommendations for public use.

But the state refused to hand them over when requested by a director at University of California, Berkeley School of Public Health.

So Joel Moskowitz, Ph.D., sued the state under the California Public Records Act.

Moskowitz, Director at the Center for Family and Community Health at UC Berkeley’s School of Public Health explained to KPIX 5 the reason he sued. “I would like this document to see the light of day because it will inform the public that there is concern within the California Department of Public Health that cellphone radiation is a risk, and it will provide them with some information about how to reduce those risks.”

When asked why he thinks the state is trying to suppress this document, he said, “They claim that this would lead to chaos and confusion among the public, I suspect that they were afraid of the reaction from the telecommunications industry should they publish this document. In fact, they even argued that in their brief.”

In a tentative ruling Friday, a judge found the documents are, in fact, public record and the public should have a right to see it.

The judge stated that there is significant public interest in DPH’s investigation into risks associated with cellular phone use and advising the public as to those risks.

Moskowitz cites new research that finds a significant relationship between cellphone use of 10 or more years and increased brain tumor risk.

The Department of Public Health would not comment on the ruling or if it intends to release the documents. Lawyers note they could appeal.

The FCC says there is no evidence of a “definite link between wireless devices and cancer or other illnesses.”

But, Moskowitz, who believes cellphones do pose health risks and urges users to limit their contact with them, hopes the ruling will at least help call attention to the issue.

  1. This concern goes back to the days of the “Brick.”

    1. theotherhanddude says:

Wish I had an old brick phone. Makes for a cool paperweight.

  2. Paul King says:

Never let people’s health get in the way of graft and profit margin.

  3. Jeffrey Gee says:

Cell phones use less power, but use higher frequencies comparable to microwave ovens. I would use hands free devices or the speaker phone and not stick it next to your head if possible!

  4. Alex Schmitt says:

Regardless of the findings — telling the average person to limit their cellphone use will be as effective as the “just say no” anti-drug campaign. We are too far gone in our addiction.

    1. Actually, “Just say no” worked. And quite well I might add.

  5. Gardog Cman says:

Just another example of the scientifically under educated public. An elementary knowledge of radiation physics would inform you the type of radiation emitted by cell phone devices can hardly penetrate a few layers of skin.

    1. Carl Mayo says:

then please explain how a few minutes of cell phone use compromises the blood-brain barrier for the next 5 hours?

      1. Similarly, perhaps you can explain how it is that drinking non-purified water can compromise your immune response.

    2. A “few layers” of skin? You DO realize that there are only two layers of skin, right? Do the words dermis and epidermis ring any bells?

  6. Carl Mayo says:

the loudest defenders of cell phones are the people who are the most addicted to them

  7. I imagine some of the first studies about smoking met the same legal battles……

  8. I use the phone on “speaker” and hold it in front of my mouth. Radiation energy drops by the inverse square of the distance. Double the distance and 1/4 the power density. It’s not much to begin with in modern digital phones. The old brick phones were analog and a significant higher power output as indicated by their massive batteries.

  9. Imagine that…the State deciding for US what we should know and be able to read! This doesn’t scream “controls” to people, what does? Moskowitz is a hero for exposing this.

  10. theotherhanddude says:

As I understood it, cordless phones release exponentially more radiation than cell phones.

  11. Gina Exner says:

The brain tumor is glioblastomia it is the most aggressive of any tumor, and their is NO cure, because receiving radiation treatment for a tumor caused by radiation, is NO way to treat this thing. Chemo same outcome, it doesn’t work, just excels the situation.

  12. Doug Day says:

Maybe Silicon Valley should be re-named Squamous Cell Valley…

  13. Ed Cole says:

The FCC says there is no evidence of a “definite link between wireless devices and cancer or other illnesses.”
Wow that sounds EXACTLY like the big tobacco company-sponsored health reports on cigarettes.

  14. Cellphones have been investigated (for alleged cancer risks) for years. A Swedish study years ago found no increased risks. I am sure the lawyers and courts will find otherwise.

  15. Samuel Green says:

The day they release this cell radiation data will be the same day the FBI and every large police departments admit they use IMSI catchers like StingRay, almost daily.

In other words that will never happen

  16. Looks like the phone companies are going to have to cough up substantial additional bribe money for the prancing chihuahuas in Sacramento.

  17. Why don’t those of you who believe this malarky just step away from the cell phones and go back to using only land-lines? Leave the rest of us to our risk – it is our health after all.

  18. tim maguire says:

If only shouting “tobacco” made cell phones dangerous, you’d be on to something for sure. But it doesn’t. Oh well. You can still scare people, so there’s that.

  19. Anti-racists say there is a RACE problem that can only be solved when the third world pours into EVERY White country and “assimilates.”

What if I said there was a RACE problem that could only be solved if hundreds of millions of non-Blacks were brought into EVERY Black country? How long before people realize I’m not talking about a RACE problem, but the conclusion to the BLACK problem?

They say they are anti-racist. What they are is anti-White.

    Anti-racist is a codeword for anti-White.

  20. I know people that thought that electricity was bad because it would “leak” out of the wall. This article is BS and has no factual connection to the science of Physics, Biology…. Leave it to someone from San Francisco the land of fruits and nuts.

  21. Smith Dee says:

Maybe this is why Californians are sooooooooo brain dead…

  22. I’m no expert, but I’ve been using cell phones 30 years. The oldest phones, you wouldn’t want anywhere near you and they weren’t. The antennas were attached to the roof of your car and they had so much power you could probably call the moon on a clear night. LOL These were 3 watt phones.

Today? They’re .6 of one watt power or less. That’s very little comparatively speaking. Next to your head? I seriously doubt there’s much to worry about there. Unless, of course, like anything else, you abuse it and live on it. Texting itself is no worry because the unit isn’t even close to your head. So it’s just talking and not much of that is really done with the modern phones. Just go by a school when it lets out. They’re all on the phone, but texting to social media. Not talking on them.

When you consider that today everything is wireless, you’re body is being bombarded by RF on a continual basis. Your Microwave, your WiFi (2 or 3 different frequencies), your cordless home phones, your TV, some refrigerators use wireless for their temperature sensors. Even my automatic toilet flusher is wireless. Cell Phones are just a small part of this.

Information in the public interest should always be public. Information hidden from the public is NOT in the public interest. It serves only those who want to control the public – illegitimately.

    1. Jack Murphy says:

Why do I get the feeling that Cali is fighting the release of this paper because they want everyone to carry a cell phone? The cattle must all wear cow bells.

  24. Jerry Snaper says:

Hmmmm, could it be the excessive use of cell phones have cooked the minds of the insane democrats? They certainly seem to have shrunken brains.

  25. Warnings to reduce exposure to children have been out for over a decade. Dr. Devra Davis, founder and president of the Environmental Health Trust, and Dr. Ronald Herberman, founding director of the University of Pittsburgh Cancer Institute, issued recommendations in 2007 calling for reduced exposure and providing precautionary advice.

In 2008, Dr. Herberman presented a report to the oversight and government reforrm committee titled “Tumors and Cell Phone use: What the Science Says.” In addition, Dr. Herberman presented advice regarding cell phone use in a memo to his staff in 2008, stating, “Do not allow children to use a cell phone, except for emergencies. The developing organs of a fetus or child are the most likely to be sensitive to any possible effects of exposure to electromagnetic fields.”

Environmental Health Trust has promoted safe use of technology and reduced exposure for over a decade. Look to for more information.

  26. Thank you for sharing this information. It’s a shame that the risks of cell phone radiation are being hidden from us behind a corporate veil.
